Project Description:

The applicant proposes a new 3.6 acre life of mine, sand and gravel mine on a 36.25 acre parcel owned by the applicant. The maximum depth of excavation is 40 feet, staying above the groundwater table. The proposed hours of operation are Monday - Friday 7:30 am - 4:30 pm with no operation on Saturday, Sunday and Legal Holidays. Berms will be constructed to mitigate noise impacts. The mine would be reclaimed to grassland upon termination of mining.

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a renewal and modification to the State Pollutant Discharge Elimination System (SPDES) Permit NY0183695, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The facility is a publicly owned treatment works (POTW) that receives flow from domestic and commercial users. Wastewater consists of treated sanitary wastes. The sewage collection system consists of both separate and combined sewers. The treatment plant was constructed in 1989 to provide secondary treatment for a design flow of 2.0 MGD. The treatment plant was expanded to provide a design flow of 2.5 MGD 12 month rolling average in 2008. The facility discharges treated sewage via Outfall 001, to the Hudson River, a class C water.

The following changes to the permit are proposed: Added Whole Effluent Toxicity testing requirements: Added influent samples for both BOD5 and Suspended Solids; Changed "effluent limit type" from Report to Monitor throughout; Removed Antimony from the permit because there is no Water Quality Standard (WQS) for Class C waterbody; Removed Zinc from the permit because there is no reasonable potential for the effluent concentration to exceed the WQS; Added a Mercury Minimization Program (MMP) requirement to have the permittee develop, implement, and maintain a MMP in accordance with TOGS 1.3.10; Updated the Combined Sewer Overflow (CSO) Best Management Practices page and the requirements for CSO Long Term Control Plan; Included additional monitoring requirements for Outfall 002; Added Storm Water Pollution Prevention Plan for POTWs; Added a revised page for the Discharge Notification Requirements; Added a General Requirements section; and, updated the Recording, Reporting and Additional Monitoring Requirements page.

The permit includes updated forms. Details of changes are specified in the draft permit and fact sheet which may be viewed and printed from the Department web site at: http://www.dec.ny.gov/permits/6054.html.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
