Project Description:

The proposed project includes realigning approximately 70 ft of Unnamed Tributary to Fox Creek (Class C) into its original channel. Approximately 120 yds of material will be excavated for the new streambed. Approximately 460 yds of medium stone fill, approximately 45 yds of light stone fill and 4,000 yds of select fill will be placed in the current streambed and adjacent to the undermining bank below the road shoulder of CR 9.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Opportunity for Public Comment:

Project Description:

The applicant proposes to modify their existing Freshwater Wetland permit to include use of the algaecide. Earthtec, to reduce the occurrence and extent of harmful algae/cyanobacteria in Collins Lake. Earthtec will be applied by boat over up to 28 acres of the 56.3-acre lake and will be used up to four times during the summer months.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.
