Public Notice

Pursuant to Environmental Conservation Law 13-0105, 13-0338 and 13-0339a, the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

NYS DEC's Division of Marine Resources has filed a Notice of Emergency Adoption (1st Readoption) with the New York State Department of State to amend 6 NYCRR Part 40, Marine Fish, to amend management strategies for sharks, squid and Atlantic cod.

There are no anticipated adverse impacts: there are no mandates for local governments, and there are no costs to NYS DEC, local municipalities, or the regulated public.

This notice will be published in issue 24 of the State Register on June 17, 2020.

Notice of Adoption of Amendments to 6 NYCRR Sections 701.13 and 701.14 - Clarification of Class I and Class SD Best Usages;

Notice is hereby given that on May 26, 2020 the New York State Department of Environmental Conservation (NYS DEC) adopted amendments to 6 NYCRR Sections 701.13 and 701.14, Clarification of Class I and Class SD Best Usages. The adopted rule making amends 6 NYCRR 701.13 and 701.14 to clarify the intent of the 2015 I/SD Rule Making that the best usages of Class I and Class SD saline surface waters were, and remain, "secondary contact recreation and fishing" and "fishing," respectively. The rule becomes effective upon publication in the State Register.

Acceptable Method for Measuring Ambient Air Concentrations of Hydrogen Sulfide

I, Steven E. Flint, with the powers delegated to me by New York State Department of Environmental Conservation (NYS DEC) Commissioner Basil Seggos, approve the Jerome J605 Hydrogen Sulfide Analyzer as a method acceptable to NYS DEC to measure hydrogen sulfide (H2S) pursuant to section 257-1.3(b) to be employed by NYS DEC staff to determine the ambient air concentrations of H2S as set forth under section 257-5.
