Project Description:

The applicant is proposing modifications to existing NYS Fair Haven Beach State Park infrastructure within the Coastal Erosion Hazard Area (CEHA) of Lake Ontario to protect the facility from impacts associated with high water events on the lake. The proposed work includes the elevation of the west parking lot above base flood levels and expansion of the east parking lot to improve vehicle and pedestrian circulation. The work also includes the following: parking and traffic flow reorganization of the west parking lot; replacement of an existing waterline underneath the parking lot; creation of an emergency access staging area; installation or reconstruction of sidewalks, crosswalks, and an elevated boardwalk through proposed protective dunes; and the creation of a green picnic area.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Office of Parks Recreation & Historic Preservation

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Applicant proposes the replacement of existing tollbooths with overhead electronic gantries resulting in 0.37 acres of disturbance to the adjacent area of Class 1 NYSDEC Freshwater Wetland CAM-18. Proposal includes minor reconstruction of existing travel lanes and construction of a communications building, generator, transformer, parking and access road amounting to 0.04 acres of new impervious surface and 0.33 acres of grading within the 100 ft. adjacent area of wetland CAM-18.
