Project Description:

The project sponsor proposes to place four (4) electric line poles within NYS Freshwater Wetland WD-27 (Class II) associated with a new utility line corridor. In addition, managing the Right-of-Way around this utility line will change approximately 16,000 square feet of forested wetland area to a more scrub-like area managed to provide similar functions and benefits to the surrounding undisturbed wetland. An additional electric line pole would be placed in the state regulated 100 foot wetland adjacent area. Additional temporary disturbances of approximately 12,500 square feet and 6,000 square feet are proposed in the wetland and adjacent area respectively just to complete the installation. Overall project activities include cutting trees, installing electric poles and wires, connecting to the Central Hudson Gas & Electric Coldenham Substation, and constructing the proposed battery storage facility which is not located in state wetlands.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Montgomery Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

This project involves approximately 12,000 square feet (sq. ft.) of disturbance to the 100-foot adjacent area of DEC-regulated freshwater wetland YL-39, class 1, and 340 sq. ft. of disturbance to the 100-foot adjacent area of DEC-regulated freshwater wetland WU-11, class 3, associated with resurfacing an existing path for the creation of a 10-ft.-wide bicycle and pedestrian trail. The project also involves disturbance to an unnamed tributary of the Basher Kill, class C(T), associated with the installation of a 11.5-ft.-wide by 7-ft.-high culvert.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
