Notice of Adoption of 6 NYCRR Part 257, Air Quality Standards

Pursuant to Sections 1-0101, 1-0303, 3-0301, 19-0103, 19-0105, 19-0107, 19-0301, 19-0303, 19-0305, 71-2103, and 71-2105 of the Environmental Conservation Law (ECL), the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

6 NYCRR Part 257, subparts 257-2 through 257-10, list the New York State Air Quality Standards (SAQS) promulgated by NYS DEC over several decades. A number of these SAQS are outdated and have been superseded by Federal air quality standards and will be repealed or revised. Several of the required test methods are also outdated and they have been replaced with new language allowing the testing methodology to evolve as analytical methods improve.

The Division of Air Resources (DAR) repealed portions of this regulation to achieve parity with federal standards and support the Department's mission to preserve and protect air quality.

Notice of Adoption of 6 NYCRR Subpart 227-2, Reasonably Available Control Technology (RACT) for Major Facilities of Oxides of Nitrogen (NOx)

Pursuant to Sections 1-0101, 3-0301, 3-0303, 19-0105, 19-0107, 19-0301, 19-0302, 19-0303, 19-0305, 19-0311, 71-2103, 71-2105 of the Environmental Conservation Law (ECL), the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

NYS DEC is adopting the revisions to 6 NYCRR Subpart 227-2, Reasonably Available Control Technology (RACT) for
Major Facilities of Oxides of Nitrogen (NOx) and 6 NYCRR Part 200, General Provisions. The revisions to Subpart 227-2 entail the removal of dated references, emission limitations, and practices. The revisions to 6 NYCRR Part 200 entail the updating of references.

Notice of Proposed Rule Making - 6 NYCRR Part 351 Regulations - Public Comment Period, Availability of Documents, and Public Hearing

Notice is hereby given that the New York State Department of Environmental Conservation (NYS DEC) is proposing a new 6 NYCRR Part 351 Plastic Bag Reduction, Reuse, and Recycling. The proposed rule sets forth the requirements of Titles 27 and 28 of Article 27 of the Environmental Conservation Law with respect to the prohibition on the distribution of film plastic bags; allowable reusable bags; and the recycling of film plastic by stores. The regulations also address the related requirements for manufacturers. This rule making is referred to as Part 351.

The Notice of Proposed Rule Making is available in the November 27, 2019 issue of the State Register. NYS DEC will accept written public comments through Monday, February 3, 2020. Additional details are provided below.

NYS DEC will give equal weight to written and oral statements. Since a cumulative record will be compiled, it is not required for interested parties to attend the hearing.

Clean Water State Revolving Fund (CWSRF) for Water Pollution Control
Drinking Water State Revolving Fund (DWSRF)

Final FFY 2020 Intended Use Plans (IUPs) and request for review of projects added since issuance of the Draft IUPs

The New York State Environmental Facilities Corporation (NYS EFC), the New York State Department of Environmental Conservation (NYS DEC), and the New York State Department of Health (NYS DOH) have prepared the Final Federal Fiscal Year (FFY) 2020 Intended Use Plans (IUPs) for the Clean Water State Revolving Fund (CWSRF) and the Drinking Water State Revolving Fund (DWSRF). The IUPs include lists of projects that may receive financial assistance between October 1, 2019 and September 30, 2020.

NYS EFC is seeking comments from the public regarding projects that were added to the Annual Project Priority List after publication of the Draft 2020 CWSRF and DWSRF IUPs. This request includes review of these projects for compliance with the New York State Smart Growth Public Infrastructure Policy Act. The list of new CWSRF projects is available on NYS EFC's website at: http://www.efc.ny.gov/2020-CW-IUP, and the list of new DWSRF projects is available on NYS EFC's website at: http://www.efc.ny.gov/2020-drinking-water-iup. Comments must be submitted by 5:00 p.m. Friday, December 13, 2019.
