State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The NYSDEC has made a tentative determination to issue a permittee-initiated modification to the existing State Pollutant Discharge Elimination System (SPDES) NY0000078.

Garlock Sealing Technologies LLC manufactures a range of rubber sealing products. The facility discharges treated industrial wastewater, stormwater, non-contact cooling water, and boiler blowdown to Red Creek, a class C water.

The following changes to the permit are proposed: the total residual chlorine compliance level for Outfall 011 has been changed from 30 ug/l to 50 ug/l; trichloroethene monitoring has been added to Outfall 019; inspection and repair of the Outfall 019 conveyance has been incorporated into the Schedule of Submittals; and, Outfall 08A monitoring requirements have been removed.
