The applicant proposes to add 30.9 acres to an existing 5 acre life-of-mine bluestone mine. Blasting, mechanical saws, and a portable crusher/screener are authorized for use at the mine. No washings operations are proposed. The site is located off State Route 8, 0.1 miles from the intersection of Nettie Axtell Road along a multi-use multi property private road.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant is proposing to address ongoing toe erosion that is causing slope failure to 350 feet of streambank along with Class C (TS) East Kill (FIN# H-240-82-133). The proposal icludes the realignment of the stream channel, construction of a hardened riffle, removal of a berm, re-establishment of floodplain connectivity, and the planting of a riparian buffer. The proposal involves impacts along approximately 650 linear feet of stream, excavation of 4,684 cubic yards of sediment, the addition of 3,882 cubic yards of fill materials below the ordinary high-water mark, 1,323 cubic yards of rock rip rap for toe stability, 8 root wads, and 1,680 live stakes. The stream corridor will be re-vegetated with native riparian grasses and 950 trees and shrubs.

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
