Project Description:

The applicant proposes to disturb a portion of an unnamed tributary to Tennanah Lake [WIN# D-80-20-4-P 281-1, Class C(T)], NYS Freshwater Wetland RO-5 (Class 2), and its 100-foot Adjacent Area in order to excavate and fill in conjunction with the construction of pools, riffles, and other trout habitat. There will be 850 linear feet of disturbance to the stream; the total area of disturbance to the Freshwater Wetland is approximately 3,600 square feet; the total area of disturbance to the Adjacent Area is approximately 340 square feet. The project is located at 78 County Road 96, in the Town of Fremont, Sullivan County.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes to treat 2 ponds; 1.76 acres within "Pond 3" and 0.39 acres within "Pond 4", both of which are within New York State Freshwater Wetland F-27, Class 2, with aquatic pesticide Cutrine Plus (act. ingredient: Copper Ethanolamine Complex, mixed) for control of algae; and aquatic pesticide Avast (act. ingredient: Fluridone) for control of Curley Leaf Pondweed.
