Project Description:

The applicant proposes wetland impacts as part of a 79 parcel subdivision. A total of 0.19 acres of wetland and 0.37 acres of regulated wetland adjacent area will be impacted, primarily by road construction. For mitigation, a wetland enhancement project has been planned.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Clifton Park Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Article 19 Air State Facility

Project Description:

The Department has prepared a draft permit and made a tentative determination to issue an Air State Facility permit for the Mohawk Fine Papers Inc Waterford Facility. This facility is a non-integrated mill which has the capacity to produce approximately 203 tons per day (tpd) of fine writing and publication papers (non-integrated mills utilize paper pulp which is either recovered or pulped and bleached offsite). The mill is basically comprised of the following operations which have been combined into "emitting units": 1) paper making; includes stock preparation, sheet forming and drying, and sizing; 2) paper converting; 3) steam generation; 4) wastewater treatment; 5) shipping, receiving, and warehousing; and 6) miscellaneous support operations including a machine shop and fire suppression system. Of these, the emitting units 1 through 3, inclusive, and 6 are comprised of operations which emit regulated air contaminants.

The facility will operate under federally enforceable emission limits to cap out of Title V permitting and Reasonably Available Control Technology (RACT) requirements for Oxides of Nitrogen (NOx). Combustion of No. 2 fuel oil at this facility will be limited to 2,675,000 gallons in any 12-month period (annual max, rolled monthly). This facility fuel limitation effectively caps NOx emissions below the Title V and 6 NYCRR Part 227-2 (NOx RACT requirements) applicability thresholds, and caps SO2 emissions below the Title V applicability threshold. The emissions will be tracked on a monthly basis pursuant to 6 NYCRR 201-7 to verify the emissions, and a certification of compliance with these caps will be submitted annually.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
