Project Description:

The applicant proposes to withdraw up to 3,456,600 gallons per day (gpd) of water for snowmaking and 57,600 gpd for potable water supply. Water for snowmaking will be from Clear Creek [Standard C(T)] through the use of two pumps with a capacity of 1,200 gallons per minute each; and Potable water will be from a water well. The draft permit includes various minimum acceptable passby flows in Clear Creek at the water withdrawal intake point by dates. The applicant will also be required to monitor stream flows and maintain records as directed by the Department.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue the renewal of the Title V Facility Permit for the Flexo Transparent Inc facility located on Wasson Street in the City of Buffalo. The permit carries over previously accepted VOC emissions caps for two emission units. The caps limit emissions to 45 tons per year (tpy) and 49 tpy respectively. The caps limit emissions from the presses below 50 tpy applicability thresholds. The facility is subject to 40 CFR 63 Subpart KK, the Printing and Publishing NESHAP, and has chosen to commit to limiting the facility's emissions of Hazardous Air Pollutant (HAPs) under the Subpart to less than 25 tpy for total HAPs and less than 10 tpy for any individual HAP. Flexo Transparent Inc is subject to 40 CFR 64, Compliance Assurance Monitoring (CAM), since the facility has potential pre-control device VOC emissions greater than 50 tpy, which is the major source threshold level, and a control device is used to achieve compliance with an emission standard.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
