Project Description:

The Department of Environmental Conservation has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems permit NY0260827.

The facility discharges via Outfall 001 and 002. Outfall 001 is sanitary sewage only, without the admixture of industrial or other wastes. The septic system is designed for a flow of 28,120 gallons per day. No sampling or limits are required. Outfall 002 is a floor drain in the school bus wash station to the oil-water separator to swale, then to detention basin. All discharges infiltrate to groundwater and are not expected to reach surface waters. The following changes to the permit are proposed: Corrected the receiving water for Outfall 002 to groundwater. Added a daily maximum benzo(a)pyrene limit. Action levels for benzene, toluene and xylene have been removed from Outfall 002. An effluent limit has been added for benzene to Outfall 002. Effluent limits have been added for toluene, ethylbenzene, and total xylenes to Outfall 002. Replaced MBAS (Foaming Agent) analysis with Foam (visible) with a limit of "None" to test for surfactants.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes the discharge of 1.5 MGD of treated wastewater from the Village of Coxsackie Wastewater Treatment Plant, located at 88 South River St. in Coxsackie. The applicant is conducting facility upgrades to eliminate storm sewer overflows which will increase their permitted discharge from 1.25 MGD to 1.5 MGD. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on the information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed project prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought or for the overall project. SPDES #NY-0033545

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
