PBS and CBS Facilities - Authorizing Non-Owners to Submit Facility Registration Applications
Owners of a Petroleum Bulk Storage (PBS) or Chemical Bulk Storage (CBS) facility are required to register their facility with DEC.
As of 2008, the Environmental Conservation Law (ECL) defines the facility owner (PBS or CBS) to be the owner of the property where the tanks are located (see the April 2009 issue of the Tank Bulletins for the New York State Bulk Storage Program for details on the law change).
The ECL and regulations (6 NYCRR Part 613 for PBS and 6 NYCRR Part 596 for CBS) allow the owner to authorize another individual to submit/update registration information on behalf of the owner. To assist in this process, DEC offers suggested language and a form (see below) that an owner can use to delegate this authority to another individual.
The completed authorization form should be kept on file by the facility owner and the duly authorized representative, and provided to DEC upon request.
