Municipal Solid Waste Processing Facilities

A municipal solid waste processing facility is a facility where municipal solid waste is received after collection and is then separated or processed to recover recyclables or to produce a refuse-derived fuel.


Any facility that performs post-collection separation and/or processing of municipal solid waste (MSW) to recover recyclables or to produce a refuse-derived fuel must obtain a permit. These facilities must meet the design and operating requirements identified in 6 NYCRR 360.19 and 6 NYCRR 362-2.3.

To become a new municipal solid waste processing facility or to modify or renew an existing permit, complete the Solid Waste Management Facility Permit Application and contact the Regional Permit Administrator in your region. Annual Reporting

MSW Processing Facilities are required to submit an annual report to the Department. For additional details about recordkeeping and reporting requirements, see 6 NYCRR 360.19(k) and 6 NYCRR 362-2.4.
