Generator Requirements:

Generators that generate more than 220 pounds of hazardous waste or more than 2.2 pounds of acute hazardous waste in a calendar month (SQGs and LQGs) are required to use the Hazardous Waste Manifest form.

Generators must prepare the Manifest, including signing and dating the Generator's certification, according to the instructions found in Part 372, Appendix 30. Detailed box by box instructions are in Chapter 4 of this online training. It is allowable for an "authorized agent" of the Generator to sign and date the hazardous waste manifest form.

Generators must distribute copies of the Hazardous Waste Manifest form postmarked within 10 calendar days of the shipment date to NYS DEC and to States that want the form. The Generator will need to make photocopies of the form to submit to NYS DEC, as the form does not have enough copies itself.

Generators must retain a copy of each Manifest form for at least three years.

Hazardous waste going to foreign countries may need two manifest forms, one for each country.

Generators must use a permitted Transporter and a TSDF authorized to handle the waste.

The form must be legible. If you can't read the data, neither can we.

Transporter Requirements:

Transporters must sign and date the initial Transporter's acknowledgement of receipt and assure that all copies of the manifest form are available for additional transporters. They must keep one copy in the transportation vehicle and obtain the signature of and deliver the remaining copies to the subsequent transporter or TSDF.

Transporters must retain a copy of each Manifest form for at least three years.

Treatment, Storage and Disposal Facility Requirements:

TSDFs must note any hazardous waste discrepancies, complete the Hazardous Waste Report Management Method Code box and sign and date the certification of receipt. If discrepancies are discovered and they cannot be resolved between the Generator and the TSDF within 15 calendar days, the TSDF must notify the generator state and disposal state. This includes rejected and unmanifested hazardous waste shipments. Information required in this notification can be found in Chapter 5, TSDF Discrepancy Reporting.

TSDFs must distribute copies of the Hazardous Waste Manifest form postmarked within 10 calendar days of the waste receipt date to NYS DEC and to States that want the form.

TSDFs must retain a copy of each Manifest form for at least three years.
