Local Solid Waste Management Plan (LSWMP) Public Participation
Planning units must make the LSWMP available for public review and comment, before it is submitted to the DEC for review and approval.
In order to meet the requirements of Subpart 366-3, planning units must complete the following:
- Make the draft LSMWP available for public comment for a minimum of 45 days
- Hold one public meeting to present an overview of the LSWMP and receive comments, with public notice in a publication of wide circulation at least 15 days prior to the meeting
- Prepare a responsiveness summary to address all comments received, both written and verbal, and submit it to the Department as part of the draft LSWMP for review and approval
Once the plan is determined to be approvable, another public comment period and responsiveness summary may be required if the Department or planning unit conclude that the approvable LSWMP differs significantly from the first draft LSWMP
