This rulemaking is required to ensure that New York maintains compliance and consistency with requirements of the Atlantic States Marine Fisheries Commission's (ASMFC) Interstate Fishery Management Plan (FMP) for Atlantic striped bass. The FMP requires that states adopt a prohibition on the use of gaffs when fishing for striped bass during the recreational season. This rulemaking also removes the commercial tag price cap and updates federal reporting requirements.

Comment period is open through May 22, 2023.

DEC and Buffalo Niagara Waterkeeper to Hold Virtual Outreach Event for the Buffalo River Area of Concern (AOC) on May 24

Organizations will Provide a Progress Update and Invite Public Comments on the Continuing Restoration of the Buffalo River Area of Concern 
 
What: The New York State Department of Environmental Conservation (DEC) and Buffalo Niagara Waterkeeper (BNW) will hold a virtual outreach event to update the public about ongoing efforts to restore natural resources in the Buffalo River Area of Concern (AOC), and the proposed removal of the ‘Degradation of Benthos’ Beneficial Use Impairment’ (BUI). Buffalo Niagara Waterkeeper, in partnership with DEC and Erie County, coordinates these restoration efforts under the Buffalo River AOC Remedial Action Plan (RAP).

Benthos refer to the organisms that typically reside in the bottom substrate, including sediment, of water bodies like the Buffalo River. They are critical to life because they comprise the base of the food chain.

The Buffalo River AOC is located in the City of Buffalo, Erie County, New York and includes the historically industrialized portion of the river beginning at its mouth (where it outlets to Lake Erie), and continuing upstream approximately six miles to the Bailey Avenue bridge. The Degradation of Benthos BUI was originally designated as impaired in the 1980s due to low diversity and abundance of the benthic macroinvertebrate community and evidence of sediment toxicity. Extensive sediment toxicity and benthic community assessments completed after the removal of contaminated sediments in the river indicate no impairment to benthic organisms due to sediment contamination currently exist, and that the criteria established to remove the Degradation of Benthos BUI have been met.
 
draft report, which details the completed actions and assessments supporting the BUI removal, is available for public review. Public comments on the draft report and proposed BUI removal may be made at the May 24 virtual event and through BNW’s website until June 11, 2023.

Come celebrate the dawn chorus as we monitor the progression of spring bird migration. These outdoor surveys begin at 7:30 AM. Meet outside the visitor center. After a brief introduction, we’ll head out on the trails. Beginners are always welcome. Bring binoculars if you have them. In case of inclement weather, these programs will be canceled.

This clinic is designed for beginner to intermediate level photographers/nature viewers interested in learning the basics of wildlife photography, perhaps some new tips and tricks, or to network with fellow nature enthusiasts! The clinic will be led by Rob O’Connor, a DEC attorney and avid wildlife photographer who has spent the last six years developing a diverse portfolio based on wildlife encounters throughout New York State and beyond. Attendees can expect to learn the basics of wildlife photography, including best camera settings and where to spot wildlife on the landscape, followed by a guided photo session that will focus on using natural lighting conditions, as well as adapting to changing circumstance to capture photos of birds and other wildlife.

Attendees are encouraged, but not required, to bring the following items:

  • A camera. Any camera. Even your smartphone! Please be advised that if you plan to rely on a smartphone for this clinic, it is strongly recommended that you pair it with a spotting scope or other long lens because most birds are tiny and don’t like to get too close humans.
  • If using a DSLR or mirroless camera, it is strongly recommended that you pair it with a lens with a minimum focal length of 200mm.
  • A tripod, especially if using a telephoto lens.
  • Binoculars are strongly encouraged for all. If you need a pair, please ask in your RSVP.
