Notice is hereby given that the New York State Department of Environmental Conservation (DEC) filed a Notice of Proposed Rulemaking with the Department of State to amend the State's existing 6 NYCRR Part 199 Forest Tax Law regulations. The Forest Tax Law program provides private landowners a significant real property tax reduction on their enrolled forest lands if they agree to follow a long-term timber management plan written and administered by a professionally trained forester. The proposed rulemaking aims to improve the program by lessening the administrative burdens placed on participants and Department staff while strengthening the sustainable forest management standards.

Public Comment Hearing

Public comment hearings for the proposed rulemaking will be held before an Administrative Law Judge (ALJ) via electronic webinar on September 13, 2022, at 1:00 p.m. and 6:00 p.m. The electronic webinar format is reasonably accessible to persons with impaired mobility.
Registration is required for any person who wishes to provide a public statement during the hearing. No registration is required for listening to the hearing only. Registration must be done in advance of the hearings and the deadline to do so is 1 p.m. on August 23, 2022.

The Department will provide interpreter services for hearing impaired persons, and language interpreter services for individuals with difficulty understanding or reading English, at no charge, upon written request submitted no later than Tuesday, August 23, 2022. The written request must be addressed to ALJ Richard Sherman, NYS DEC - Office of Hearings and Mediation Services, 625 Broadway, 1st Floor, Albany, NY 12233-1550 or emailed to ALJ Richard Sherman at ohms@dec.ny.gov.
