621.4 Applications for specific permits.
The requirements for particular permits given in this section include additional information to be furnished in order for the application to be determined complete. Since details of procedure to be followed depend upon whether a project is considered major or minor, a list of specific actions considered minor is also included for each permit type. Implementing regulations for each permit have been promulgated by the department; in some cases interpretive guidelines have also been issued. These regulations, which are cited at the beginning of each subdivision below, should be consulted for supplemental requirements when preparing a permit application. They are available from the regional permit administrators at the locations listed in Appendix 1 of this Title, infra.
(a) Permits under title 5 of ECL article 15 and Part 608 of this Title - Use and protection of waters:
(1) Disturbance of the bed or banks of a protected stream.
(i) A complete application must include plan and profile sketches of the proposed project and a map at a scale of 1 inch = 2,000 ft. or larger showing its location. The department may also require submission of plans.
(ii) Minor stream bed or bank disturbance actions include the following: repair or in-kind replacement of existing structures; disturbances of less than 50 lineal feet along any 1,000 feet of watercourse.
(2) Construction, reconstruction, [or] repair, removal or breach of a dam[s].
(i) A complete application must include the information specified in Part 608. [the permit program implementing regulations.]
(ii) All dam projects are considered major. Ordinary maintenance activities for a dam or its appurtenant works are exempt from permitting requirements. [Minor dam projects include only repairs of existing registered dams.]
