Part 10, Sections 10.2, 10.3, 10.7 and 10.9 - Sportfishing (freshwater) and Associated Activities - Express Terms - Adopted January 17, 2017

Express Terms

Title 6 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (NYCRR), Part 10 "Sportfishing Regulations", is amended as follows:

§ 10.2 Boundary water fishing regulations.

Existing paragraph 10.2(a)(1) is amended to read as follows:

(1) Notwithstanding the provisions of section 10.1 of this Part and in accordance with Table A in paragraph (2) of this subdivision, no person, when fishing in Lake Erie, Lake Ontario, Niagara River and St. Lawrence River and their tributaries upstream to the first barrier impassable to fish except tributaries to the St. Lawrence River in Franklin County and Clinton County [where statewide regulations apply,]which are exempt from regulations in this section, shall take or possess on these waters or the shores thereof fish of the species listed:

(i) other than during the open season specified for such species;

(ii) of a size less than specified for such species; and

(iii) in excess of the daily limit for such species.

Existing paragraph 10.2(a)(2) is amended to read as follows:

(2) Fishing regulations for Lake Erie, Lake Ontario, Niagara River, St. Lawrence River and their tributaries to the first barrier impassable by fish, except [tributaries to the St. Lawrence River in Franklin and Clinton Counties where General Angling Regulations, as provided in section 10.1 of this Part, apply] Cattaraugus Creek at the Cattaraugus County/Erie County border, where Lake Erie and tributary regulations extend to the Springville Dam .

Existing subparagraph 10.2(a)(2)(ii) is amended to read as follows:

Existing paragraph 10.2(c)(2) is amended to read as follows:

(2) Salmon River (Oswego County). The special regulations set forth in this paragraph shall apply to the Salmon River from the [mouth]upstream most navigation buoy located between the breakwalls at the mouth of the river upstream to the County Route 52 Bridge in Atmar and all tributaries of that section.

Existing clause 10.2(c)(2)(ii)(a) is amended to read as follows:

(a) Fishing from one-half hour after sunset to one-half hour before sunrise is prohibited, except fishing is permitted [from one-half hour after sunset to one-half hour before sunrise from Lake Ontario to] 24 hours per day downstream of the Route 3 bridge from April 1st through August 14th.

Existing clause 10.2(c)(3)(g) is amended to read as follows:

(g) Additional special fishing regulations for the Salmon River, Oswego County, from County Route 52 bridge upstream to Lighthouse Hill Reservoir. Unless permitted by the Department, [N]no person may fish at any time except from County Route 52 bridge in Altmar upstream to a marked boundary at Beaverdam Brook from September 15th through May 15th, and from a marked boundary upstream of the New York State Salmon River Fish Hatchery property upstream approximately 0.6 mile to a marked boundary at the Lighthouse Hill Reservoir tailrace from April 1st through November 30th. No person, while fishing in these places during these times, shall:

(1) fish from one-half hour after sunset to one-half hour before sunrise;

(2) use fishing tackle other than a traditional fly fishing rod, reel and line;

(3) use other than single artificial flies, including weighted flies, which are permitted;

(4) use a weighted fly with more than one-eighth ounce added weight;

(5) add weight to the line, leader, swivels or artificial fly in any manner such that the weight hangs lower than the attached fly when the line or leader is suspended vertically from the rod;

(6) use less than 20 feet of floating, sinking, or combination floating/sinking flyline, or shooting head immediately behind the leader and in front of any running line or other backing;

(7) use supplemental weight such that the weight is the primary means of propelling the cast rather than the fly line or shooting head;

(8) use a hook with more than one hook point or with a gap of greater than one-half inch;

(9) use a leader, including tippet, measuring in excess of 15 feet;

(10) place additional weight on the line or leader, whether fixed or sliding at a distance exceeding four feet from the fly; and

(11) fail to immediately release all fish without unnecessary injury.

Existing paragraph 10.2(h)(2) is amended to read as follows:

Existing paragraph 10.2(i)(4) is amended to read as follows:

(3) No person may engage in fishing at anytime in the Boquet River from [marked boundary below Willsboro Dam upstream to Route 22 in Willsboro]the Route 22 bridge in Willsboro, downstream approximately 1500 feet to the marked boundary at the base of the cascades.

10.3 Additional special fishing regulations for certain inland waters.

New paragraph 10.3(e)(21) is added to read as follows:

(23) Indian River at Rossie from west side (downstream) side of County Route 8 bridge upstream to highest point of Rossie Falls in St. Lawrence County - closed March 16th until the opening of Walleye season in May.

(24) Grasse River from the downstream side of the ALCOA Road Bridge upstream to the upstream side of the Main Street Bridge in the Village of Massena in St. Lawrence County - closed March 16th until the opening of Walleye season in May.

§ 10.7 Taking fish with bows and spears.

Existing paragraphs 10.7(c)(8) through 10.7(c)(10) are repealed:

[(8) In Oswego County, bullhead and suckers may be taken from January 1st through May 15th from Grindstone Creek (downstream of the dam at Fernwood), Little Salmon River (downstream from the bridge at Arthur), Ninemile Creek (downstream of Route 104A), Eightmile Creek (downstream of Route104A), Salmon River (downstream of NY Route 3), Red Creek or Sunset Bay Creek, Otter Branch Creek, Sage Creek and Snake Creek.

(9) In Wayne County, bullhead and suckers may be taken from January 1st through May 15th from Black Creek Bay and Red Creek Bay.

(10) In Cayuga County, bullhead and sucker may be taken from January 1st through May 15th from Sterling Creek (downstream of Route 104A), Sterling Valley Creek (downstream of Route 104A), Eightmile Creek and Ninemile Creek.]

§ 10.9 Snatching.

New paragraph 10.9(c)(6) is added and reads as follows:

(6) In Cortland County, suckers may be taken from the Otselic River from the State Route 23 Bridge in Lower Cincinnatus to the County Route 169 Bridge in Landers Corners and in the Tioughnioga River from the County Route 121 Bridge in Blodgett Mills to the State Route 221 Bridge in Marathon .

Existing subdivision 10.9(d) is repealed:

[(d) Snatching and blind snatching are permitted with hooks having not more than two hook points to take whitefish in Piseco Lake from January 1st through November 30th.]
