§272.1 General classification

(a) The air quality within the political boundaries of Dutchess County shall be maintained as set forth in Part 256, Ambient Air Quality Standards--Classification System, using Levels III, II, and I as detailed below.

(b) The classification of the air over the Hudson River shall be the same as the classification of the adjacent land mass.

§272.2 Level III

(a) All that area bounded by a line commencing at the intersection of the Hyde Park-Poughkeepsie town line and the east bank of the Hudson River; thence easterly along the Hyde Park-Poughkeepsie town line to Route 9G; thence southerly along Route 9G to the Poughkeepsie city line; thence clockwise along the Poughkeepsie city line to Fallkill Creek; thence southwesterly along Fallkill Creek to Clinton Street; thence southerly along Clinton Street to Hooker Avenue; thence due west to Academy Street; thence southerly along Academy Street to Route 9; thence southerly along a straight line to the junction of Croft Road and Spackenkill Road; thence due south to Route 9; thence southerly along Route 9 to Old Post Road; thence southerly along Old Post Road to Sheafe Road; thence southwesterly along Sheafe Road to De LaVergne Avenue; thence due west to the east bank of the Hudson River; thence northerly along the Hudson River bank to the beginning point.

(b) All that area west of a line commencing at the intersection of the east bank of the Hudson River and Interstate Route 84; thence easterly along Interstate Route 84 to Fishkill Creek; thence southwesterly along Fishkill Creek to Washington Avenue; thence southwesterly along Washington Avenue to De Puyster Street; thence southwesterly along De Puyster Street to Union Street; thence northwesterly along Union Street to Howland Avenue; thence southwesterly along Howland Avenue to Route 9D; thence southwesterly along Route 9D to the Beacon city line; thence westerly along the city line to the east bank of the Hudson River.

§272.3 Level II

(a) All that area bounded by a line commencing at the intersection of the Columbia-Dutchess county line and the east bank of the Hudson River; thence easterly along the Columbia-Dutchess county line to Route 9G; thence southerly along Route 9G to County Road 79; thence southeasterly along County Road 79 to Rockefeller Lane; thence easterly along Rockefeller Lane to Mill Road; thence southerly along Mill Road to Route 9; thence southeasterly along a straight line to the intersection of Yantz Road and Orlich Road; thence southerly along Yantz Road to the Redhook-Rhinebeck town line; thence southwesterly along a straight line to the intersection of Route 9G and Route 308; thence southerly along Route 9G to the Hyde Park-Rhinebeck town line; thence clockwise along the Hyde Park town line to County Road 41; thence due east to the Taconic State Parkway; thence southerly along the Taconic State Parkway to the LaGrange-Pleasant Valley town line; thence clockwise along the LaGrange town line to Route 55; thence southeasterly along Route 55 to the Beekman-Pawling town line; thence southerly along the Beekman-Pawling town line to Byrne Road; thence westerly along Byrne Road to Grape Hollow Road; thence due west to the Taconic State Parkway; thence southerly along the Taconic State Parkway to the Dutchess-Putnam county line; thence westerly and southwesterly along the Dutchess county line to the east bank of the Hudson River; thence northerly along the Hudson River bank to the beginning point; except that area delineated as Level III,

(b) All that area within the corporate limits of the village of Pawling.

All that area in Dutchess County not delineated as Levels III and II.
