§273.1 General classification

(a) The air quality within the political boundaries of Erie County shall be maintained as set forth in Part 256, Ambient Air Quality Standards--Classifications System, using Levels IV, III, II and I as detailed below.

(b) The classification of the air over Lake Erie and the Niagara River and their islands shall be the same as the classification of the adjacent land mass.

§273.2 Level IV

All that area west of a line commencing at a point on the Lake Erie shoreline due west of the Intersection of Route 5 (Lake Shore Road) and Big Tree Road in the Town of Hamburg; thence due east to said point; thence easterly along Big Tree Road to Bay View Road; thence northeasterly along a straight line to the junction of McKinley Parkway and Willett Road; thence northerly along a straight line to the junction of McKinley Parkway and the Buffalo city line (McKinley Circle); thence northerly along McKinley Parkway to Choate Avenue (McClellan Circle); thence due north to Cazenovia Creek; thence northeasterly along a straight line to the Intersection of the Buffalo city line and the Buffalo River; thence northeasterly along the Buffalo River to the Lehigh Valley railroad tracks; thence northerly along the Lehigh Valley Railroad track to Harlem Road; thence northerly along Harlem Road to Walden Avenue; thence westerly along Walden Avenue to Best Street; thence westerly along Best Street to Jefferson Avenue; thence northerly along Jefferson Avenue to Delavan Avenue; thence westerly along Delavan Avenue to a point due south of the junction of Myron Avenue and Kenmore Avenue; thence due north to said point; thence due north to Thorncliff Avenue; thence westerly along Thorncliff Avenue to Delaware Road; thence northerly along Delaware Road to Cleveland Avenue; thence westerly along Cleveland Avenue to Delaware Avenue; thence northerly along Delaware Avenue to Fletcher Street; thence due east to the Erie Railroad tracks; thence northerly along the Erie Railroad tracks to the Erie-Niagara county line; except that area known as Grand Island.

§273.3 Level III

All that area west of a line commencing at a point on the Lake Erie shoreline due west of the intersection of Amsdell Read and Route 5 (Lake Shore Road) in the Town of Hamburg; thence due east to said intersection; thence southeasterly along Amsdell Road to Southwestern Boulevard (Route 20); thence northeasterly along Southwestern Boulevard to Transit Road (Route 20); thence northerly along Transit Road to Como Park Boulevard; thence easterly along Como Park Boulevard to the Lancaster village line; thence counterclockwise around the village line to Cayuga Creek; thence easterly along Cayuga Creek to a point due south of the intersection of Cemetery Road and Broadway (Route 20); thence due north to said intersection; thence northerly along Cemetery Road to Walden Avenue Road; thence westerly along Walden Avenue to Stony Road; thence northerly along Stony Road to Route 33; thence northerly along a straight line to the intersection of Main Street, Sheridan Drive, and Thompson Road; thence northerly along Thompson Road to Greiner Road, thence westerly along Greiner Road to Transit Road (Route 78); thence northerly along Transit Road to Tonawanda Creek (Erie-Niagara county line); except that area delineated as Level IV and that portion of Grand Island delineated as Level II.

§273.4 Level II

(a) All that area west of a line commencing at a point on the Lake Erie shoreline at the northern boundary of the Cattaraugus Indian Reservation; thence easterly along the reservation boundary to Route 20; thence northeasterly along Route 20 to the Hamburg-Eden town line; thence easterly along the town line to East Eden-Hamburg Road; thence southerly along East Eden-Hamburg Road to Keller Road; thence easterly along Keller Road to Feddick Road; thence southerly along Feddick Road to Shero Road; thence easterly along Shero Road to Zimmerman Road; thence easterly along Zimmerman Road to Shero Road; thence easterly and northeasterly along Shero Road to Patchin Road; thence easterly along Patchin Road to Route 219; thence northerly along Route 219 to Omphalious Road; thence easterly along Omphalious Road to Cole Road; thence northerly along Cole Road to Behn Road; thence easterly along Behn Road to Route 240; thence northerly along Route 240 to East Aurora-Jewettville Road; thence easterly and northeasterly along East Aurora-Jewettville Road to the East Aurora village line; thence counterclockwise along the village line to Lawrence Road; thence northerly along Lawrence Road to East Aurora-Porterville Road; thence northeasterly along East Aurora-Porterville Road to the Elma-Marilla town lines; thence northerly along the town line to the Marilla-Lancaster town line; thence northerly along the town line to the Marilla-Alden town line; thence easterly along the town line to the Erie-Wyoming county line; thence counterclockwise along the Erie county line to the Erie-Niagara county line; except those areas classified as Levels IV and III.

(b) All that area within the corporate lines of the Village of Springville.

(c) All that area within the corporate lines of the Village of Gowanda.

(d) All that portion of Grand Island west of a line commencing at a point on the north bank of the Niagara River (West Branch) due south of the intersection of Spaulding Road and Base Line Road; thence due north to said intersection; thence northerly along Base Line Road to the Governor Thomas E. Dewey Thruway; thence northwesterly along the Thruway to Long Road; thence westerly along Long Road to West River Parkway; thence due west to the Niagara River.

§273.5 Level I

All that area in Erie County not delineated as Levels IV, III and II.
