§289.1 General classification

(a) The air quality within the political boundaries of Niagara County shall be maintained as set forth in Part 256, Ambient Air Quality Standards--Classifications System, using Levels IV, III, II and I as detailed below.

(b) The classification of the air over the Niagara River and Lake Ontario shall be the same as the classification of the adjacent land mass.

§289.2 Level IV

[Environmental Conservation Law, §§ 15, 77]

(a) All that area south and west of a line commencing at a point on the Niagara-Erie county line due south of the intersection of Payne Avenue and Sweeney Street; thence due north to said point; thence northeasterly along a straight line to the junction of Erie Avenue and Nash Road (Division Street); thence north-easterly along Erie Avenue to Niagara Falls Boulevard; thence northwesterly along Niagara Falls Boulevard to Ruie Road; thence westerly along a straight line to the intersection of Ward Road and Payne Avenue; thence due southwest to the Niagara River.

(b) All that area south and west of a line commencing at a point on the north bank of the Niagara River due south of the intersection of Pine Avenue and Military Road; thence due north to said point; thence northwesterly along Military Road to Lockport Road; thence westerly along Lockport Road to Interstate Route 190; thence northwesterly along Interstate Route 190 to Upper Mountain Road; thence westerly along Upper Mountain Road to Lewiston Road; thence due west to the Niagara River.

(c) All that area bounded by a line commencing at the intersection of Route 31 and Upper Mountain Road in the town of Lockport; thence due south to Hinman Road; thence easterly along Hinman Road to the Lockport city line; thence counterclockwise along the city line to Route 78 (Transit Road); thence northerly along Route 78 to Route 31 (West Avenue); thence westerly along Route 31 to the beginning point.

§289.3 Level III

(a) All that area south and west of a line commencing at the junction of the Wheatfield-Pendleton town line and the Niagara-Erie county line (Tonawanda Creek); thence northerly along the town line to Loveland Road; thence westerly along Loveland Road to Route 425 (Shawnee Road); thence northerly along Route 425 to Mapleton Road; thence westerly along Mapleton Road to Lockport Road; thence westerly along Lockport Road to Route 429 (Hoover Road); thence northerly along Hoover Road to the Wheatfield-Lewiston town line; thence westerly along the town line to the Niagara-Lewiston town line; thence westerly along the town line to Garlow Road; thence northerly along Garlow Road to the Tuscarora Indian Reservation boundary; thence clockwise along the reservation boundary to Route 104 (Ridge Road); thence westerly along Ridge Road to the Lewiston village line; thence counterclockwise along the Lewiston village line to the Niagara River; except those areas delineated as Level IV.

(b) All that area bounded by a line commencing at the intersection of Lockport-Pendleton town line and Transit Road (Route 78); thence northerly along Transit Road to Hamm Road; thence easterly along Hamm Road to Locust Street; thence northerly along Locust Street to Washburn Street; thence northerly along Washburn Street to East Avenue; thence northeasterly along East Avenue to Mill Street; thence northwesterly along Mill Street to VanBuren Street; thence northeasterly along VanBuren Street to Lake Avenue; thence northerly along Lake Avenue to Old Niagara Road; thence westerly along Old Niagara Road to Leete Road; thence westerly and southwesterly along Leete Road to Lower Mountain Road; thence westerly along Lower Mountain Road to the Lockport-Cambria town line; thence counterclockwise along the Lockport town line to the point of beginning; except that area delineated as Level IV.

§289.4 Level II

(a) All that area south and west of a line commencing at the intersection of the Lockport-Royalton town line and the Niagara-Erie county line (Tonawanda Creek); thence northerly along the town line to Lincoln Avenue; thence easterly along Lincoln Avenue to Hollenbeck Road; thence northerly along Hollenbeck Road to Route 77 (Ridge Road); thence easterly along Route 77 to Mill Road; thence northeasterly along Mill Road to Gasport Road; thence northerly along Gasport Road to Route 31; thence easterly along Route 31 to Bolton Road; thence northerly along Bolton Road to Slayton Settlement Road; thence westerly along Slayton Settlement Road to Day Road; thence northerly along Day Road to the Lockport-Newfane town line; thence westerly along the town line to Route 104 (Ridge Road); thence westerly along Route 104 to Route 93; thence northwesterly along Route 93 to Route 18; thence northerly along Route 18 to Lake Road; thence due north to Lake Ontario; except those areas delineated as Levels IV and III.

(b) All that area bounded by a line beginning at the intersection of Telegraph Road (Route 31A) and the Niagara-Orleans county line; thence westerly along Telegraph Road to the Middleport village line; thence clockwise along the village line to the intersection of the eastern portion of the village line and the Erie Canal; thence easterly along the canal to the Niagara-Orleans county line; thence southerly along the county line to the beginning point.

(c) All that area bounded by a line commencing at the intersection of Transit Road and Keller Avenue in the town of Newfane; thence due west to Eighteenmile Creek; thence southerly along Eighteenmile Creek to a point due west of the intersection of McKee Street and Lockport-Olcott Road; thence due east to said intersection; thence easterly along McKee Street to Transit Road; thence northerly along Transit Road to the beginning point.

§289.5 Level I
