Part 82: Use Of Fish and Wildlife Management Act Cooperator Areas For Hunting, Trapping and Fishing

§82.0 Introduction

Unless otherwise provided in the regulations for an individual area, the following regulations shall apply to the use of Fish and Wildlife Management Act cooperator areas for hunting, trapping and fishing.

§82.1 Restrictions

Hunting, trapping, fishing or trespassing for any purpose whatsoever, except by cooperating landowners, lessees or members of their immediate families, or persons acting with their consent, or the written permission of the regional supervisor of the Department of Environmental Conservation having jurisdiction or his agent, is prohibited within any area posted with "restricted area" or "safety zone" signs.

§82.2 Hunting, Trapping and Fishing

Hunting, trapping and fishing are permitted outside areas posted with "restricted area" or "safety zone" signs.

§82.3 Roads and Parking Areas

Vehicular use of roads posted against such use is prohibited. Where required by posted notice, vehicles shall be parked only in designated parking areas, and vehicles so parked shall not exceed the number specified.

§82.4 Camping

Camping is prohibited except pursuant to written permission of the regional supervisor of the Department of Environmental Conservation having jurisdiction or his agent or the cooperator.

§82.5 Prohibited Acts

The following acts are prohibited:

(a) Building or maintaining a fire, except a fire for cooking by camp stove or within other suitable container and confined to a designated site on the area. No fire shall be lighted until all inflammable material surrounding it has been removed to the extent necessary to prevent its spread, and no fire shall be left unattended.

(b) Removing, cutting or willfully damaging or destroying living vegetation of any kind, except pursuant to written permission of the regional supervisor of the Department of Environmental Conservation having jurisdiction or his agent or the cooperator.

(c) Target or indiscriminate shooting.

(d) Injuring, defacing, disturbing or befouling any part of an area or any building, sign, equipment or other property found thereon.

(e) Discarding or depositing any trash, waste or litter on lands or waters, except in waste receptacles when provided for such purpose.

(f) The use of snowmobiles, trail bikes or any other motorized vehicle without written permission of the landowner or lessee.

§82.6 General Provisions

The following general provisions shall apply:

(a) All persons shall comply with regulatory signs posted by the Department of Environmental Conservation on the area.

(b) All personal property shall be removed from the area when a person leaves.

(c) The department reserves the right to eject any person from the area for disorderly conduct, intoxication or any other behavior which endangers the general safety of persons on the area.

(d) All applicable provisions of the Environmental Conservation Law shall be in effect under this order.
