§92.1 Applicability
(a) The provisions of this Part shall apply to the Stewart Airport Cooperator Area ("area").
(b) The area shall extend from Drury Lane westward to the Conrail property and shall be bounded on the south by Route 207, Forrester Road and Highway 208 and to the north by Interstate Highway 84.
§92.2 Special Permit
(a) No person shall enter the area from the date the area is opened to public hunting until the permit station is closed unless he possesses a special permit issued by the Department of Environmental Conservation. Such permits shall be obtained at the permit station which shall be open daily from one-half hour before legal hunting hours until one-half hour after legal hunting hours.
(b) Applicants shall surrender their hunting, fishing, hunting and fishing or big game license in order to receive a special permit.
(c) A special permit shall be valid only for the date of issue and shall not be transferable. No person shall transfer his permit to another person.
(d) No person shall fail to show his special permit to anyone requesting to see it.
(e) No person shall fail to stop at the permit station before leaving the area, surrender his special permit and submit any game taken for examination.
(f) No person shall obtain a permit by fraud. Permits obtained by fraud shall be void.
(g) After the close of the small game season and prior to the date the area is reopened to public hunting, no person shall enter the area for the purpose of hunting unless he has obtained permission from the Department of Transportation. (An office of the DOT is located at Stewart Airport.)
§92.3 Hunting Regulations
(a) No person shall hunt in the area other than on the same side of the road on which his vehicle is parked. No person shall cross any road while hunting in the area.
(b) No more than three persons shall hunt together in any one party.
(c) No hunter or party hunting together shall use more than two dogs.
(d) No person shall engage in target or promiscuous shooting in the area.
(e) No person shall carry afield a rifle or pistol (except a muzzleloading rifle during the regular big game season) in the area from the date the area is opened to public hunting to the close of the small game season.
(f) No person shall hunt in the area on Christmas Day and New Year's Day.
§92.4 Fishing Regulations
(a) No person shall fish in the area except on the following waters:
(1) Wilkins Pond, which is located east of Barron Road just north of the gate.
(2) Rowe's Pond, which is located east of Barron Road approximately one-quarter mile north of the intersection of Barron Road and Route 208.
(3) Tenny's Pond, which is located west of Drury Lane approximately one-half mile south of the intersection of Drury Lane and Route 84.
(4) Maroney's Pond, which is located east of Drury Lane approximately one-half mile south of the intersection of Drury lane and Route 84.
(b) No person shall fish from or otherwise use a boat in Wilkins Pond, Rowe's Pond, Tenny's Pond or Maroney's Pond.
(c) No person shall fish in Tenny's Pond from September 1st through the last day of February.
(d) No person shall fish in Wilkins Pond, Rowe's Pond or Maroney's Pond, from October 1st through the last day of February.
Note: A person who fishes through the ice is required to obtain a special permit as provided by 92.2 of this Part.
§92.5 General Provisions
(a) No person who is hunting in the area shall park a vehicle in other than a designated parking area. No person who is hunting in the area shall park in a designated parking area if the parking quota for that area is filled.
(b) No person in the area shall hunt or trespass in areas posted as restricted areas.
(c) No person in the area shall:
(1) engage in disorderly conduct;
(2) be intoxicated;
(3) engage in any behavior which may endanger the safety of persons or property.
(d) The department may refuse to issue a special permit to anyone, revoke a special permit or eject a person from the area for noncompliance with any of the provisions of the Environmental Conservation Law or any regulation promulgated thereunder, including the regulations contained in this Part.
(e) No person shall fail to obey all regulatory signs of the department.
(f) No person shall picnic, litter, build fires, damage fences or gates, annoy livestock, molest equipment or other farm property, damage standing crops or newly planted fields, take fruit or other farm produce, pick flowers, cut or break branches of trees or shrubs, hunt or shoot near or otherwise disturb persons who may be working in the area.
(g) No person shall bring a boat trailer into the area.
(h) Except as otherwise provided in this Part, the provisions of the Environmental Conservation Law and of regulations promulgated thereunder in relation to open hunting and fishing seasons, hunting hours, manner of taking, use of firearms and other activities shall apply to hunting and fishing in the area.
