This is in response to your appeal, pursuant to the New York State Freedom of Information Law ("FOIL", codified at §§ 84-90 of the Public Officers Law ["POL"]), from the constructive denial of access to certain records pertaining to 182 Fairfield Drive, Town of Patterson/Brewster, Putnam County, State Line Food & Beverage, LLC, Spill #0507404.
It is my understanding that since my last letter to you of September 2, 2008, Region 3 program staff responded to your request on September 4, 2008 with all responsive records. Staff is not asserting any exemptions regarding these records. Based upon this disposition which fully satisfies your FOIL request, we deem your FOIL appeal, above referenced, withdrawn.
