Dear Mr. Duran:
On February 24, 2005, we received by telecopier your appeal about your request for access to certain records under the New York State Freedom of Information Law (FOIL, Public Officers Law (POL) sections 84 through 90). Your appeal, which was dated February 16, 2005, stated you had requested a document from Region 4 of the Department of Environmental Conservation on February 14, 2005 but had not received a response to that request.
The requested record is the Synagro Corporation research project application for sand and gravel pit reclamation. Toni Mauceri, of DEC Region 4, made arrangements for you to obtain a copy of the application and confirmed that Region 4 was not withholding any portions of it.
On March 4, 2005, you sent a fax confirming that all the material responsive to this request was received on March 3, 2005. Accordingly, your appeal is resolved and the appeal file will be closed.
