The DEC Office of Hearings and Mediation Services has received from DEC Staff the documents that were withheld in response to the above FOIL request. These documents were provided to us to review in connection with your March 31, 2004 appeal.
In the course of sending us the documents, DEC Staff determined that three of the withheld documents were accessible in their entirety and a fourth was accessible in part under FOIL. Copies of these documents are enclosed with the present letter. We are reviewing the other withheld documents and the decision on your appeal will be contained in a separate letter.
