Chemical Bulk Storage (CBS)
Facility Registration
Registration is required for all underground tanks, and for above-ground stationary tanks of 185 gallons or greater capacity, that store hazardous substances listed in 6NYCRR Part 597 or mixture thereof.
Registration is not required for non-stationary tanks. Out-of-service tanks must be registered until they
are permanently closed in accordance with NYSDEC regulations. Process tanks, assembly line tanks,
aboveground farm tanks, and certain other tanks (see 6NYCRR Part 596.1(b)) do not have to be registered.

Major Oil Storage Facility License A license to operate is required for oil terminals with a combined storage capacity of 400,000 gallons or more and transport vessels operating in the waters of the State, when petroleum is transferred between vessels. A vessel transferring petroleum to an on-shore terminal does not otherwise require a license.
Petroleum Bulk Storage Facility Registration Registration is required for all petroleum storage tanks at a facility (property) that meet any of the following criteria:

a) Underground (larger than 110 gallons and more than 10% underground); used to store petroleum (other than heating oil used on-site), and the site is not a farm or a residence.
b) Combined storage capacity of all petroleum storage tanks (not including heating oil tanks less than 1100 gallons or farm/residential non-retail motor fuel tanks 1,100 gallons or smaller)is greater than 1,100 gallons
c) Tank used to store used oil (see registration fee worksheet for details).

Registration is not required for non-stationary tanks. Out-of-service tanks must be registered until they are permanently closed in accordance with NYSDEC regulations.

If the facility is located in Nassau, Suffolk, Rockland, Westchester, or Cortland counties, refer to Bulk Storage Program Regional Contacts, and call the appropriate county agency to obtain information regarding registration requirements and application form and instructions.
Liquefied Natural Gas Facility Permits

Liquefied Natural Gas Facility Permit Permits are required for facilities who store Liquefied Natural Gas (LNG) or convert LNG into natural gas through vaporization. The facility capacity shall not exceed 70,000 gallons. Permits are not required in certain situations. See 6NYCCR 570.1(b) & (d).

Pesticide Product Registration All pesticide products required to be registered by the USEPA require registration in NYS prior to sale or use. Pesticide products containing new active ingredients or representing major changes in labeling require an extensive review prior to registration in NYS. See application procedures (PDF) 219 KB

Control or Elimination of Aquatic Vegetation

All pesticides labeled for the direct application to surface waters are classified as restricted use pesticides,
and can only be purchased, used, and possessed by a certified pesticide applicator or the holder of an Aquatic Pesticide Purchase Permit.

The direct application of a pesticide to any water body is allowed only under an Article 15 Aquatic Pesticide Permit.

A permit may not be required for a water body that is one acre or less in size and has no outlet to surface waters.
Submit aquatic Pesticide Permit applications to the DEC regional office in which the water body is located.

Purchase a Restricted Use Pesticide An Aquatic Pesticide Purchase Permit may be issued to an uncertified person to purchase and use a restricted
use aquatic pesticide in a water body that is one acre or less in size and has no outlet to surface waters.
Submit aquatic pesticide permits to the DEC regional office in which the water body is located.

Commercial Pesticide Technician License (Entry level) Any individual certified to engage in the commercial application of a general use pesticide or any pesticide under the direct supervision of a certified commercial applicator requires a license. Entry level pesticide applicator examinations are conducted through DEC Regional Offices.
Commercial Pesticide Applicator License
Any individual certified to use or supervise the use of any commercial application of pesticides or sell or supervise the sale of a restricted use pesticide requires a license. Application form (PDF) 69 KB Renewals and recertifications are processed in DEC's Central Office.
Private Pesticide Applicator License Any individual who uses or supervises the use of a restricted use pesticide on property they own or lease to produce an agricultural commodity requires a license.
Aquatic Anti fouling Paint Applicator License Any individual certified in the commercial application of general use aquatic antifoulant paints requires a license.
Commercial Sale of Restricted Pesticide Products Any person who distributes, sells, offers for sale, purchases for the purpose of resale, or possesses for the purpose of resale, any restricted use pesticide must hold a commercial permit from the department.
Pesticide Business/Agency Registration (for hire or
agency pesticide application)
Each agency that applies pesticides and each business offering, advertising or providing the services of commercial application of pesticides must register with the department. Application and Instructions (PDF) 110 KB
