New York State Pollutant Discharge Elimination System ("SPDES") General Permit for
Concentrated Animal Feeding Operations (CAFOs) (GP-0-14-001)
The New York State Department of Environmental Conservation (the Department) is proposing to issue a renewal of SPDES Environmental Conservation Law General Permit for Concentrated Animal Feeding Operations (CAFOs) GP-0-09-001. Upon issuance, this general permit will be an interim general permit, replacing the expiring general permit, GP-0-09-001 which became effective on July 1, 2009, was modified on July 29, 2013 expires on June 30, 2014. The Department elects to issue an interim general permit, with no changes, in order to devote sufficient time to work with a diverse stakeholder group to consider potential future changes to the ECL CAFO general permit. The general permit (GP-0-14-001) will be effective on July 1, 2014 and will be in effect for a limited time. The interim general permit will authorize the operation and construction of a CAFO that is defined in 6 NYCRR § 750-1.2(a)(21) and as described in Environmental Conservation Law (ECL) § 17-0105(16) and Appendix A of GP-0-14-001. Owners or operators of existing CAFOs with coverage under GP-0-09-001 shall be covered by the interim general permit.
Other than changing the permit number and effective and expiration dates, there are no changes from GP-0-09-001. The proposed renewal permit, GP-0-14-001 was posted on the ENB and the CAFO webpage on December 18, 2013. The public comment period runs through January 17, 2014. There will be no public hearings.
