Section 401 Water Quality Certification - USACOE Nationwide Permits

Under Section 401 of the Clean Water Act, the New York State Department of Environmental Conservation has responsibility for issuing or denying Water Quality Certification (WQC) for the USACOE Section 404 Nationwide Permits. On April 20, 2012, the Department issued the Water Quality Certification for the 2012 Nationwide Permits (NWPs) which became effective March 19, 2012. The WQC lists 24 NWPs that are covered under the blanket WQC, as long as they meet the General Conditions listed in the WQC. Nine NWPs are covered under the blanket WQC as long as they meet the General Conditions and Special Conditions listed. Eight NWPs have been denied a blanket WQC and require the applicant to obtain an individual WQC from the Department.
