Section 401 Water Quality Certification - U.S. Army Corps Of Engineers Nationwide Permits

Under Section 401 of the Clean Water Act, the New York State Department of Environmental Conservation has responsibility for issuing or denying Water Quality Certification (WQC) for the U.S. Army Corps Of Engineers Section 404 Nationwide Permits. On March 7, 2017, the Department issued the Water Quality Certification for the 2017 Nationwide Permits (NWPs) which became effective March 19, 2017. The WQC lists twenty NWPs that are covered under the blanket WQC, as long as they meet the General Conditions listed in the WQC. Thirteen NWPs are covered under the blanket WQC as long as they meet the General Conditions and Special Conditions listed. Ten NWPs have been denied a blanket WQC and require the applicant to obtain an individual WQC from the Department.
