Dear Mr. Reagan:
Following our review of the Beneficial Use Determination (BUD) Petition submitted by Lafarge North America, requesting approval to use waste tires as an alternative fuel in the cement kilns, we are conditionally approving this request. This Beneficial Use Determination has been assigned #797-4-01. This approval is conditioned upon compliance with the following requirements:
- The beneficial use determination (BUD) will take effect at the point when the waste tires are used as fuel (i.e. fed into the cement kiln).
- Storage and Management of the waste tires shall be in accordance with the Lafarge Building Materials 6 NYCRR Part 360 Waste Tire Storage Permit (4-0214-1/112 issued 4/21/2006).
- Any cessation of burning waste tires as alternative fuel requires the facility to remove all waste tires in accordance with the Waste Tire Storage Facility's Closure Plan.
- The Department reserves the right to modify, suspend or revoke this determination at any time should conditions warrant. Additionally, this determination does not exempt the operation from any other local, state, or federal requirements.
- An annual report must be filed within 60 days of the end of each calendar year. The annual report must include the following:
- number of days and duration of operations using waste tires as an alternative fuel
- number of waste tires used as an alternative fuel.
- documentation of proper management/disposal of rejected tires.
- documentation of proper handling of collected/removed tire rims.
