CWM Chemical Services, LLC SPDES Permit

Facility Background

CWM Chemical Services, LLC facility is located in the Town of Porter, Niagara County. The facility provides aqueous treatment of hazardous and non-hazardous industrial wastes generated off site, contaminated groundwater generated onsite, and landfill leachate generated onsite. In 2003 the DEC initiated a modification to the facility's SPDES permit under New York State's Environmental Benefit Permit Strategy.

A first draft permit modification was public noticed on October 17, 2007. Comments were received from the public, and comments and a request for hearing were also received from the permittee. In response to these comments, the DEC made revisions to the draft permit. A second draft permit was noticed for public comment along with a Notice of Legislative Public Comment Hearing and Notice of Public Comment period on January 6, 2010. This second Notice also included a proposal to renew in addition to the modifications. A Legislative Public Comment Hearing was held on February 22, 2010. Following the second public notice, comments were received from the public and permittee. After further discussions and review, a third draft permit and fact sheet was noticed for public comment on March 4, 2015 and final permit issued on April 22, 2015.
