The New York State Department of Environmental Conservation (DEC) has made a final decision pursuant to Uniform Procedures to issue the following permits:

The State Pollutant Discharge Elimination System permit will be issued separately as soon as the application is transferred to a sewage disposal corporation formed and regulated pursuant to article 10 of the Transportation Corporations Law.
Notice of Issuance of Agency Findings
The NYS Department of Environmental Conservation (DEC) has prepared and issued Findings in accordance with the State Environmental Quality Review (SEQR) regulations, 6 NYCRR Part 617. These Findings certify that the requirements of 6 NYCRR 617.11 have been met and that DEC approves the project as presented in the Final EIS plans.
Acceptance of the Final Environmental Impact Statement
A Final Environmental Impact Statement (FEIS), consisting of the Draft Environmental Impact Statement (DEIS) by reference and appendix with supplements to the text of the DEIS, has been accepted by the lead agency. The final EIS is available for public review at the Department's Region 3 Headquarters, 21 South Putt Corners Road, New Paltz, NY 12561-1620 during normal business hours between 8:30 am and 4:30 pm, Monday through Friday. In addition, the FEIS is available for review during normal business hours at Town of Rosendale Town Hall, 424 Main Street, Rosendale NY 12472, (845) 658-3159.

Notice of Complete Application
Hudson River Valley Resorts, LLC (HRVR) proposes a new industrial discharge, water taking, and disturbance of natural resources associated with the development of a resort community to be located on land totaling approximately 779 acres in the Town of Rosendale, Ulster County, New York. The NYS Department of Environmental Conservation has determined that the applications for the following permits are complete:

Please Note: The original Notice of Complete Application issued December 5, 2012 contained an erroneous statement regarding the number of proposed housing units. Portions of the Article 11 Endangered/Threatened Species application are withheld from public review to protect the location of endangered species. Legislative Public Hearing and Public Comment Period
In accordance with the provisions of 6NYCRR Parts 617, a legislative public hearing will be held before an Administrative Law Judge (ALJ) to receive unsworn statements from the public on the draft EIS. The hearing will be held on Monday June 6, 2011 at the Ulster County Community College John Quimby Theater, 491 Cottekill Road, Stone Ridge, NY 12484.
The hearing location is fully accessible to persons with mobility impairment. The hearing will commence at 4:00 PM with a break at 6:00 PM, reconvening at 7:00 PM. It is not necessary to attend both sessions. The order of speakers will be determined through a sign up process. Opening statements by the ALJ will be given at 5:00 PM and 7:00 PM.
All persons, organizations, corporations, or government agencies are invited to attend the hearing and to submit oral and/ or written comments. It is not necessary to file in advance to speak at the legislative hearing. Lengthy statements should be in writing and summarized for oral presentation. Reasonable time limits may be set for each speaker to afford everyone an opportunity to be heard. Equal weight will be given to both oral and written statements. For those unable to attend this legislative public hearing and those persons wishing to provide additional comments following the hearing, written comments will be accepted no later than close of business Tuesday, July 12, 2011 and may be submitted to:

- Revision to Final Scoping Document: As revised by DEC in consultation with the Town of Rosendale on June 22, 2009, Subsection III(C)(5) now reads in its entirety (old text is in brackets [ ], new text is in bold):
5. Discuss and document the karstic characteristics of the aquifer on and adjacent to the site. Document groundwater flow and pathways in the project area using [well information] a comparison of the chemical signatures of surface and ground waters and [dye] tracer tests consistent with former ASTM Standard D5717-95. If aquifer (pump) tests are conducted for potential water supply wells, they must be designed to demonstrate the lack or presence of hydraulic connection with Williams Lake.
