Dead Endangered Species
Statutory Authority: ECL 11-0535, 11-0536 and 6 NYCRR Part 175, and Part 182
Federal Law generally prohibits the sale of endangered or threatened species, including parts and products, in interstate or foreign commerce. However, the sale of such products, manufactured prior to the Endangered Species Act (1973), or otherwise legally obtained and possessed, could be permissible in New York State with a permit from the NYSDEC, provided that substantive evidence related to the items in question proves when the products were manufactured, and from whom they were acquired.
If the items are legally obtained and possessed, a permit for the sale, of the products or by-products of the endangered or threatened species, may be issued.
Please note:
- Substantial evidence would include; notarized affidavits attesting to the authenticity of the item(s), photographs, etc.
- There is no fee for this license.
