Environmental Conservation Law
PROJECT: River Oaks Planned Unit Development, Including River Oaks Lake Expansion, River Oaks Landings No. 1 Development and River Oaks Landings Marina, Town of Grand Island, Erie County
In my decision dated April 14, 1988 regarding this project, I designated the Planning Board of the Town of Grand Island as lead agency for conduct of the environmental review under the State Environmental Quality Review (SEQR) process required for this proposed action pursuant to 6 NYCRR Part 617. This decision was based on documents submitted by the Town related to site plan approvals by the Town Planning Board.
In a letter dated April 21, 1988 from Frank Kedzielawa, Town Attorney, the Town has now clarified that the Planning Board only recommends actions to the Town Board. Since local discretionary decisions related to this project rest with the Town Board, I hereby revise my original designation of lead agency for this project.
The Town Board of the Town of Grand Island is hereby designated as lead agency for the conduct of the SEQR process for review of the River Oaks Planned Unit Development since it serves the functions previously assumed to be served by the Planning Board.
