Project Description
Algonquin Gas Transmission, LLC ("Algonquin"), a subsidiary of Spectra Energy Partners, LP, filed applications for a Certificate of Public Convenience and Necessity (Certificate) with the Federal Regulatory Commission (FERC) on February 28, 2014 to construct and operate the Algonquin Incremental Market Project ("AIM Project") which involves the expansion of its existing pipeline systems located in New York, Connecticut, Rhode Island and Massachusetts. The AIM Project includes the construction of approximately 37.4 miles of pipeline commencing in Rockland County New York and traveling in a northeast direction through Westchester and Putnam Counties in New York into Connecticut, Rhode Island and Massachusetts.

Approximately 79% of the proposed pipeline is within or adjacent to existing Algonquin pipeline right-of-ways ("ROWs"). The AIM Project will create 342,000 dekatherms per day (Dth/d) of firm pipeline capacity to deliver natural gas to the Northeast markets

New York State (NYS) Portion of the AIM Project
In NYS the AIM project consists of 15.7 miles of the replacement of 26-inch diameter pipeline with 42-inch diameter pipeline in the existing ROW and the installation of approximately 2.9 miles of new 42-inch diameter pipeline in a new ROW that will cross the Hudson River via a 0.91 mile horizontal directional drill ("HDD"). Two (2) new compressor units will be installed at Algonquin's existing Stony Point Compressor Station (Rockland County) and one (1) new compressor unit will be installed at Algonquin's existing Southeast Compressor Station (Putnam County). Modifications are also proposed to Algonquin's existing Stony Point, Peekskill and Cortlandt Meter and Regulating ("M&R") stations involving new piping, heaters and regulators and the installation of various piping, valves, and internal inspection device referred to as launchers and receivers.

Notice of Issuance of Response to Comments
The Department has completed its review of the public comments received for the Algonquin Incremental Market Project ("AIM Project") pertaining to the Water Quality Certification (WQC), Freshwater Wetlands (FWW) and Stream Disturbance (SD) permit applications and the draft Title V permit modifications for the existing Southeast and Stony Point compressor stations.

The Department has prepared a Response to Comments (RTC) (PDF) (177 KB) which summarizes the public comments received in response to the Notice of Complete Application issued on December 31, 2014 and the Legislative Public Comment Hearings held on January 21, 2015 in Brewster, New York and on January 22, 2015 in Stony Point, New York. The RTC document includes responses to comments that were provided to the Department in writing and by email, as well as the oral comments provided at the two legislative public hearings. Adjudicatory Public Hearing
An adjudicatory public hearing will not be held. Pursuant to 6 NYCRR Part 621.8 (b) and (d) the Department has determined that the comments received did not raise substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law, including the reasonable likelihood that one of the permits would be denied or can be granted only with major modifications to the project because the project, as proposed, may not meet statutory or regulatory criteria or standards.

Water Quality Certification
The Department has issued a Water Quality Certification (WQC)(PDF) (40 KB), Freshwater Wetlands (FWW) and Stream Disturbance (SD) permit and the construction of the project is subject to the conditions contained in the approvals.
