Hempstead: East Bay
Pursuant to the provisions of 6NYCRR 47.3(b), the New York State Department of Environmental Conservation, in cooperation with the Town of Hempstead, will initiate a conditional shellfish harvesting program for a portion of the uncertified shellfish lands in East Bay. In order to take advantage of this program, please read the following:
1. Program Duration:
This program will be in effect from October 15, 2007 through November 30, 2007; and April 1, 2008 through May 16, 2008.
2. Conditional Harvesting Area Description (please note all exceptions remain uncertified):
Conditional Area A: all of the uncertified shellfish lands in East Bay as described in the Notice to all shellfish harvesters, Notice of the condition of all shellfish lands located within or adjacent to the Town of Hempstead, Nassau County, New York, Dated: January 1, 2007. A map is available for viewing.
EXCEPT all the uncertified area of South Oyster Bay lying east of the Jones Beach Causeway/Wantagh State Parkway; and,
EXCEPT all the uncertified area of Hempstead Bay and Middle Bay lying west of the Meadowbrook Parkway; and,
EXCEPT all the uncertified area of East Bay lying north of a line extending easterly from the southern tip of Merrick Point to the southern tip of Great Island, on the northern end of the Goose Creek Bascule Bridge (Wantagh State Parkway); and,
EXCEPT all the uncertified area of East Bay, Merrick Bay and Mud Creek lying north of a line running due east and west through Marker G T "15" across the mouth of Mud Creek in Merrick Bay; and,
EXCEPT all that area of Sloop Channel and tributaries west of the Sloop Channel Bridge lying easterly and southerly of a line extending due north from the southernmost end of the easternmost fishing pier at Jones Beach State Park to the opposite shoreline of Deep Creek Meadow, continuing northeasterly along the southern shoreline of Deep Creek Meadow to the southwesternmost point of land at Snipe Island, and thence continuing northeasterly to the northwesternmost end of the Sloop Channel Bridge; and,
EXCEPT during the period of May 15 - September 30, all that area of Sloop Channel and the State Boat Channel lying east of a line extending southwesterly from the southwesternmost tip of Deep Creek Meadow across Sloop Channel to the opposite southern shoreline at Jones Beach State Park and all that area of the State Boat Channel lying west of the eastern entrance to Zachs Bay, and all that area of the Short Beach Boat Basin.
3. Conditions To Be Met:
When not more than 0.05 inches of precipitation is recorded in each of seven successive days, the area may be designated as "certified" (open) for the harvest of shellfish on the eighth day. The area may remain "certified" until more than 0.05 inches of precipitation is recorded within a 24 hour period.
4. Daily Public Notification:
A taped message announcing the status of the area can be heard at 516-897-CLAM (by 7:30 AM). Calls can be made to NYSDEC at 631-444-0475 (8:30 AM).
A copy of the order "opening" or "closing" the area will be posted in the NYSDEC office, East Setauket, New York.
5. Special Note
This conditional shellfish harvesting program may be suspended, revised or canceled at any time if any condition is found to exist which may be a threat to public health.

Harvesting in the Conditional Area is from sunrise to sunset.
It has been determined that runoff from snow melt can affect water quality in the conditional area; therefore, the area will be closed whenever significant runoff is caused by any snowfall of 3" or greater.
The Town of Hempstead has the management authority for town owned underwater lands, and may designate areas as open or closed for resource management purposes.
