Brookhaven: Port Jefferson Harbor

Pursuant to the provisions of 6NYCRR 47.3(b), the New York State Department of Environmental Conservation, in cooperation with the Town of Brookhaven, will initiate conditional shellfish harvesting programs for portions of the uncertified shellfish lands in Port Jefferson Harbor. In order to take advantage of the program, please read the following:

1. Program Duration: This Program is Closed

The program will run from January 15, 2015 through April 17, 2015 (both dates inclusive). Harvesting shall be prohibited in the conditional area before 8:00 am and after 4:00 pm on those days that the area is in the "open" status.

Many towns run the same program(s) from year to year. This page will be left up after the program has ended to provide general information on the conditional programs in the Town of Brookhaven.

2: Conditional Harvesting Area Description:

All of the uncertified shellfish lands in Port Jefferson Harbor as described in the NOTICE TO ALL SHELLFISH HARVESTERS, NOTICE OF THE CONDITION OF ALL SHELLFISH LANDS LOCATED WITHIN OR ADJACENT TO THE TOWN OF BROOKHAVEN Dated: January 1, 2015.

EXCEPT, All that area of Port Jefferson Harbor and tributaries lying south of a line extending northeasterly from the flagpole located at the foot of Washington Street, Poquott, to the boat house located on the opposite shoreline (Village of Belle Terre). Said boathouse is located approximately 800 yards south of the mouth of Pirates Cove on the eastern shore.

Note: The uncertified areas in Conscience Bay are NOT included in this program.


3. Conditions To Be Met:

When not more than 0.75 inches of liquid precipitation is recorded for each of seven successive days, the areas may be "OPENED" (certified) for harvesting on the eighth day and may remain "OPEN" until more than 0.75 inches of rain is recorded in 24 hours. Additionally, the Port Jefferson wastewater treatment (WWTP) plant must operate with no malfunctions that could result in the discharge of less than fully treated sewage into Port Jefferson Harbor.

Town of Brookhaven personnel will determine the amount of precipitation that is recorded daily. Wastewater treatment plant staff will determine whether the facility operated effectively.

4. Public Notification:

Daily Status Message (Open or Closed): (631) 451-6918

Daily, Brookhaven Town personnel will determine the status of the area based on rainfall and operations of the WWTP. A recorded message advising harvesters of the status of the area will be available by calling (631) 451-6918 after 7:30 a.m., seven days a week.

Prior to harvesting in this area, it is the responsibility of each harvester to determine that the area is in the "OPEN" status for that particular day by calling the phone number above. Until the "OPEN" message is available via the public notification system described above, the area in uncertified and the harvest fo shellfish is prohibited.

A copy of the order designating the area as "OPEN" or "CLOSED" will be posted at the Bureau of Marine Resources headquarters office in East Setauket, NY.

5. Special Conditions:

This conditional shellfish harvesting program may be suspended, revised or terminated at any time if water quality is determined to be in contravention of the bacteriological standards for certified shellfish lands or if any other condition is found to exist which may be a threat to public health.
