Southold: Mattituck Creek
Pursuant to provisions of 6NYCRR 47.3(b). The New York State Department of Environmental Conservation, in cooperation with the Town of Southold, will initiate conditional shellfish harvesting programs in portions of the uncertified shellfish lands in Mattituck Creek. In order to take advantage of the program, please note the following:
1. Program Duration:
The program will be in effect from December 12, 2007 through April 30, 2008, both dates inclusive. Many towns operate the same program(s) from year to year. This page will be left up after the program ends to provide general information on conditional programs in the Town of Southold.
2. Conditional Harvesting Area Description:
a) Mattituck Creek (Conditional Area A, December 12, 2007 through January 31, 2008, both dates inclusive): All of the uncertified shellfish lands in Mattituck Creek, EXCEPT all that area of Mattituck Creek lying south of a line extending easterly from the red shack on the south side of the entrance to Howards Creeek (local name) to the flagpole serving the residence at 1085 West View Drive (local landmark), and the area of Howards Creek lying westerly fo a line extending northwesterly from the dock of the Raynor residence (a white, single story home) on Point Pleasant to the dock serving the red brick house (located on Fox Hollow Road) on the opposite shore. both docks are equipped with street lamps;
b) Mattituck Creek (Conditional Areas A and B, February 1, 2008 through April 30, 2008 both dates inclusive): All of the uncertified shellfish lands in Mattituck Creek, EXCEPT all that area of Mattituck Creek lying south of a line extending easterly from the red shack on the south side of the entrance to Howards Creek (local name) to the flagpole servign the residence at 1085 West View Drive (local landmark).
3. Conditions To Be Met:
During the period December 12, 2007 through January 31, 2008 both dates inclusive, when not more than 0.20 inches of rain is recorded for each of seven successive days the area will be open for harvesting on the eighth day and remain open until more than 0.20 inches of rain is recorded in a 24 hour period.
During the period February 1, 2008 through April 30, 2008, both dates inclusive, when not more than 0.75 inches of rain is recorded for each of seven successive days the area will open for harvesting on the eighth day and remain open until more than 0.75 inches of rain is recorded in a 24 hour period.
4. Public Notification:
Each morning beginning at 7:45 AM, a recorded telephone message will announce the status of the conditional area as open or closed. The telephone number of the recorded message is 631-765-3912.
Prior to harvesting in this area, it is the responsibility of each harvester to determine whether the "open" status message has been given for the particular day. Until the "open" message is available via the public notification system described above, the area is uncertified and the harvest of shellfish is prohibited.
Copies of the orders opening or closing the area will be posted in the NYSDEC Marine Resources Headquarters Office in East Setauket.

5. Special Notes:
Holiday Closures: all conditional areas will be closed on Christmas Day, December 25, 2007 and New Year's Day, January 1, 2008.
This year's conditional harvest area will close at 4:00 pm each day. The conditional harvest area is uncertified after that time and harvesting is illegal.
This conditional program may be suspended, revised or canceled at any time if bacteriological water quality is found to be in the contravention of the bacteriolgical standard for a certified shellfish land or if any other condition is found to exist which my be a threat to public health.
