Huntington: Centerport

Pursuant to the provisions of 6NYCRR 47.3(b), the New York State Department of Environmental Conservation, in cooperation with the Town of Huntington, will initiate a conditional shellfish harvesting program in portions of the uncertified shellfish lands in Centerport Harbor. In order to take advantage of this program, please read the following:

1. Program Duration: This Program is Closed

This program will be in effect from December 15, 2017 through April 20, 2018 (both dates inclusive).

Many towns run the same program(s) from year to year. This page will be left up after the program has ended to provide general information on the conditional programs in the Town of Brookhaven.

2. Conditional Harvesting Area Descriptions (please note all exceptions remain Uncertified):

Centerport Harbor: All the uncertified shellfish lands in the southern portion of Centerport Harbor as described in clauses (ii)(a) in the NOTICE TO ALL SHELLFISH HARVESTERS, NOTICE OF SANITARY CONDITION OF ALL SHELLFISH LANDS IN OR ADJACENT TO THE TOWN OF HUNTINGTON, SUFFOLK COUNTY, STATE OF NEW YORK, dated: January 1, 2017,

EXCEPT, all that area lying southerly of a line extending easterly from the northeastern corner of the garage serving the residence at 1 Harding Court (on the western shore) to the lighthouse-like structure near the shoreline of the property at 16 Keith Court, on the eastern shore (local names, local landmarks).

All exceptions remain uncertified.

3. Conditions To Be Met:

When no more than 0.30 inches of rainfall is recorded for each of seven (7) successive days, the areas may be "OPENED" (certified) for harvesting on the eighth day and may remain "OPEN" until more than 0.30 inches of rain is recorded in 24 hours. Additionally, the two sewage pump stations near the Mill Pond in Centerport must operate with no malfunctions that could result in the discharge of less than fully treated sewage into the Mill Pond.

Town of Huntington personnel will determine the amount of precipitation that is recorded daily. Wastewater treatment plant (WWTP) staff will determine whether the pump stations operated effectively.

Harvesting shall be prohibited in this conditional area before 8:00 a.m. and after 4:00 p.m., on those days the area is in the "open" status.

4. Daily Public Notification:

Daily, Town personnel will determine the status of the area based on rainfall and confirmation of the effective operation of the WWTP. A recorded message advising harvesters of the status of the area will be available by calling (631) 351 3327 after 7:30 a.m., seven days a week.

Prior to harvesting in this area, it is the responsibility of each harvester to call the phone number above to learn whether the area is in the "OPEN" status for that particular day. Until the "OPEN" message is available via the public notification system described above, the area is uncertified and the harvest of shellfish is prohibited.

A copy of the order designating the area as "OPEN" or "CLOSED" will be posted at the Division of Marine Resources headquarters office in East Setauket, New York.

5. Special Notes:

It is the responsibility of the harvester to determine whether the "Open" message has been recorded for that particular day prior to harvesting in the conditional area. Until the official "Open" message is given through the notification procedure described above, the area remains uncertified and harvesting is prohibited.

This conditional shellfish harvesting program may be suspended, revised or terminated at any time if bacteriological water quality is found to be in contravention of the standards for certified shellfish lands OR if any other condition is found to exist which may be a threat to public health.
