Pursuant to New York State Department of Environmental Conservation (DEC) Organization and Delegation Memorandum 94-13, I have reviewed the Stipulation of Settlement and the final State Pollutant Discharge Elimination System (SPDES) permits in this matter. The executed stipulation states that: (1) the final SPDES permits are accepted by DEC Staff and the permittee as modifications to the existing permits; (2) all outstanding issues are resolved; (3) the permittee withdraws its request for a hearing; and (4) pending appeals of the March 24, 2008 Ruling on Issues in this matter are withdrawn.
Accordingly, this matter is remanded to DEC Staff to take all steps necessary to issue the final SPDES permits.
