RULING

On May 29, 2003, the DEC Staff requested that the issues ruling in the above matter be held in abeyance in light of the pending petition for a declaratory ruling currently before the General Counsel of the Department of Environmental Conservation. On June 23, 2003, I granted that request to the extent that the issues ruling would be held in abeyance until the declaratory ruling was issued or until August 22, 2003, whichever was first. The declaratory ruling has not been issued as of today, and the DEC Staff has requested a further postponement of the issues ruling.
The issues ruling will be held in abeyance until November 3, 2003, unless the declaratory ruling is issued before that date. Any application for a further extension of the stay must be sent to me, with a copy to the persons on the enclosed interim service list, on or before October 30, 2003. Please note that Mr. Gaylord's address has apparently changed, based upon a label that the Post Office attached to correspondence sent to him by the Office of Hearings and Mediation Services on August 26, 2003.
