Superfund Refinance and Reform Bill Passed
Historic legislation has been passed by the Senate to help build stronger, healthier communities throughout New York State. Governor Pataki has been working with the Legislature since 1999 on a proposal to refinance and reform all of the state's programs to clean up contaminated properties, including the State Superfund Program. The bill passed the Assembly in June 2003.
In addition to improving public health and the environment, the legislation will help encourage new investment and the redevelopment of New York's urban communities. A new State Brownfields Program is being created to encourage private investment in brownfield cleanup and redevelopment through liability reform, tax incentives, and a predictable process for cleaning up and redeveloping brownfields. Amendments to the Municipal Brownfields Program funded through the 1996 Clean Water/Clean Air Bond Act were made to encourage even more municipal participation in the program, and much needed liability reform to the state's Superfund and Oil Spill programs was enacted.
DEC looks forward to implementing this legislation which will help to protect communities, improve our state's economy, and create a brighter future for all New Yorkers.
