Project Description:
Monroe County has submitted an application to renew its Title V Facility Permit for existing processes at the Van Lare Wastewater Treatment Plant.  This sewage treatment facility is currently permitted to treat 135 million gallons per day of residential and industrial wastewater, and serves most of Monroe County.

Facility emissions are from wastewater treatment operations, two 13.4 million BTU per hour natural gas fired boilers, and two natural gas fired sludge incinerators.  The Facility meets the definition of a major stationary source, and is required to obtain a Title V Facility Permit as specified in 6 NYCRR Part 201-6, due to potential emissions in excess of 100 tons per year of sulfur dioxide (SO2) and 100 tons per year of carbon monoxide (CO).

Monroe County also proposes to retain the current facility limit on emissions of oxides of nitrogen (NOX).  The Draft Permit continues to limit the amount of sludge incinerated to 46,292 dry tons per year, to restrict NOX emissions to below the Part 212.10 Reasonably Available Control Technology (RACT) threshold of 100 tons per year.   The NOX sources at the facility are the boilers and the sludge incinerators.  For compliance verification, the facility must maintain monthly records of natural gas used by the boilers and the amount of sludge burned in the incinerators.

The application and Draft Title V Facility Permit are available for review at the Region 8 NYSDEC office.

The Department has prepared a Draft Permit and has made a tentative determination to approve this application.
In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.  The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.state.ny.us/website/dar/boss/afs/index.html.
DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.   If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.   The applicant and all persons who  have filed comments on the permit will be notified by mail of the public hearing.  Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.
An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.   A copy of the Department's permit hearing procedures is available upon request or on the Department web site at: http://www.dec.state.ny.us/website/ohms/gudph1.htm.

Filed application documents, and Department draft permits where applicable, are available for inspection under the provisions of the Freedom of Information Law during normal business hours at the address of the contact person.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:

Project Description:
The development and installation of stream erosion control structures, throughout Schyler County.  Such activities may involve any combination of the following activities:
    1. One stream crossing less than 25 feet wide in any 1000 lineal feet of stream length for the purpose of positioning equipment.
    2. Removal of trees and/or debris other than bed material that is blocking/impeding drainage, navigation or is jeopardizing the banks of a stream or structure along the stream.
    3. Within any 2000 lineal feet of stream length  the following activities shall be permitted:
    • bank and shoal shaping and removal of up to 750 cubic yards of channel material.
    • the placement of up to 500 feet of heavy rock rip rap, for the purpose of bank stabilization.
    • the placement of up to 350 feet of stone filled gabion baskets, for the purpose of bank stabilization.
    • the placement of up to 4 bed sills, for the purpose of stream bed stabilization.
    • the implementation of up to 12 in-stream stabilization structures, including but not limited to rock vanes, or cross vanes for the purpose of stream features and habitat restoration.
    1. The maintenance, repair, in kind and in-place replacement, or minor modification of existing structures and improved areas, including but not limited to rip rap, retaining walls, gabion structures, culverts, headwalls and plunge pools, within stream banks, stream channels and regulated NYSDEC Freshwater Wetlands and their 100 foot wide regulated adjacent areas.
    2. The installation of dry hydrants within protected water bodies and regulated NYSDEC Freshwater Wetlands and their 100 foot wide regulated adjacent areas.
