The
NYS Department of Environmental Conservation (department) has decided to
pursue a Department Initiated Modification (DIM) to the State Pollutant Discharge
Elimination System (SPDES) Permit (NY
003-2433, DEC Identification #:4-2732-00004/00001-0),
the Fonda-Fultonville Wastewater Treatment Plant pursuant to 6
NYCRR Part 750-1.18, New York State’s Environmental Benefit Permit Strategy
(EBPS). The changes to the permit are as follows:
Mini-Treatment
program requirements have been deleted from the permit, as there are
no significant industrial users. The Permittee is required to submit a detailed description
of the collection system and analysis of the effluent for Mercury, Total using EPA
Method 1631 within 90 days from the effective date of this permit.
The
modification would also include several other minor reporting modifications. The
Fonda-Fultonville Wastewater Treatment Plant has surface discharge into the Mohawk
River, a class C water. DEC seeks comments on the proposed
regulated activity prior to
making a final decision on permit issuance.

The applicant proposes a
new surface discharge of 4800 gpd of treated sanitary and
kitchen wastewater to a recirculating sand filter to the Muitzes Kill from a proposed
travel center located on US Route 9 in the Town of Schodack. The Department has made
a tentative determination to issue a permit for a State Pollutant Discharge Elimination
System (SPDES) permit under Article 17 of the Environmental Conservation Law. This
tentative determination indicates that the discharge regulated under this statute is
considered to satisfy regulatory standards for permit issuance, based on information
available to the Department at this time. As a tentative determination, the Department
seeks comments on the proposed regulated activity prior to making a final decision on
permit issuance. As such, this tentative determination does not signify department
approval for or endorsement of the activity for which a permit is sought, or for the overall
proposed project. A draft permit is available for inspection and comment at the regional
office listed.
