The applicant, Herkimer
County Industrial Development Agency, proposes to subdivide
and develop the former Schuyler Drive-In as a multi-tenant business and technology park.
The 109 acres parcel will be divided into 12 parcels ranging in size from 1 to 8 acres
resulting in 49 acres being identified as developable. There are no DEC regulated
freshwater wetlands or waters cources regulated under Article 15 Protection of Waters on
the parcel. There will be approximately 1.28 acres of federally regulated freshwater
wetland impacted by the project. The applicant is proposing mitigation in the form of 2.83
acres of wetland creation. The Park is within an existing water district.

The applicant proposes to
restore a section of beach front at their campground facility,
located west of NYS Route 3, 1.5 miles south of the Village of Sackets Harbor. The
proposal would reestablish a straight shoreline by filling an eroded backwater section 60'
wide x 45' long x 2"-6" inches deep. This would match the surrounding shoreline
and
lake bottom grade. Sand previously removed, incidental to seasonal beach cleaning
would be sifted and returned to the beach. In addition, dead and fallen trees would be cut
and removed along the barrier beach area to Stony Creek for safety purposes. A section
of access trail crossing a neighboring property line would be relocated into regulated
freshwater S-10, a 63 acre Class II emergent marsh. The fill would be a cone shaped fill,
100' long running from 0' to 7.5' wide x approximately 7" deep.

clear brush and small trees in an area 110' long x 27' wide, at
their residence. At the toe of slope of this area a timber retaining wall would be
constructed, at the border of upland and regulated freshwater wetland TP-5, a 102 acre
Class II wetland. The site is located at the northern terminal end of Lake of the Isles,
Wellesley Island, St. Lawrence River. The slope area would be backfilled with soil to
establish useable property for a garden.

The Department has received
a request to modify an existing permit and has drafted an
Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State
Facility Permit, at the facility located at Burrows Paper Corporation, in the town of
Lyonsdale in Lewis County. The facility has one paper machine that produces
approximately 45 tons per day of lightweight specialty tissue paper. There are two
emission units at the facility: the paper machine and steam generating boiler. The boiler
emission point is a 110 foot concrete and brick stack. The paper making process has two
emission points: the wet end and dryer hood of the paper machine. The modification is to
add two emission points to the paper making process that will have potential of emissions
from chemicals used in the paper making process.
The facility is a synthetic
minor source with emissions capped below major source
thresholds. The facility emissions for the following pollutants are being capped below
major source thresholds: PM, VOCs, NOx, SO2, CO, INDIVIDUAL HAPS, AND
TOTAL HAPS. These caps prevent the source from being subject to Title V, NOx
RACT, PSD, and any NESHAPs. The following individual HAPs are capped to prevent
ambient impacts from exceeding the DAR-1 Short term Guideline Concentrations
(SGCs), and Annual Guideline Concentrations (AGCs) thresholds include Formaldehyde,
Glycol Ether, Silicon Dioxide, and Quartz. Emissions of HCl, Ethylene Glycol, and
Ethylene Glycol Monoethyl Ether are capped to avoid Title V. The boiler is subject to the
New Source Performance Standards under 40 CFR 60, Subpart Dc.

in Watertown, New York.
