|
The Town of Ripley proposes
to install a complete water distribution system to serve the
newly created Town of Ripley Water District No. 2 and the taking of up to 12,750 gallons
per day (future maximum daily demand) water supply from previously approved sources
of the existing Ripley Water District. The new Water District No. 2 will serve 49
residential parcels and one vinyard along Route 5 northeast of the hamlet of Ripley. The
project will involve the installation of 15,110 feet of 8 inch water main, including
crossings of 8 small Lake Erie tributary streams.

The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application. Tier Environmental is located at 33 South Hyde Park Boulevard
in Niagara Falls on 3.5 acres with one railcar siding and proposes the cleaning of railroad
tankcars, truck tanks and other containers using a scrubber tank filled with 2,5000 gallons
of 50% Sodium Hydroxide solution. The scrubber tank has a control efficiency of 95%
when used during the cleaning of Titanium Tetrachloride (TiCL4) tanks. An in-stack
HCL monitor will be set to 25 ppm with an audible alarm. The wastewater is discharged
to the Niagara Falls Treatment Facility. An estimate of 4 to 6 TiCL4 railcars per month
will be cleaned. The operation is subject to the requirements of 6NYCRR Part 212.4(a)
which requires a minimum of 90% control for emissions of Hydrogen Chloride, a 'B'
rated contaminant. The draft permit contains a federally enforceable condition limiting
emissions of hydrogen chloride to less than 10 tons during any 12 consecutive month
period in order to establish the facility as a minor source not subject to the Title V
permitting requirements of 6NYCRR Part 201-6. The draft permit may be viewed and

The Department (DEC) has
prepared a Draft Permit and made a tentative determination to
renew the existing Part 373 Permit for Textron's facility at 2221 Niagara Falls Boulevard.
As a result of past management operations, a variety of chemicals used at the facility
(formerly Bell Aerospace Textron) have impacted on-site soils and groundwater, and off-site groundwater. In September 1992, DEC issued a Post-Closure Permit (No. 9-2940-00001/00079-0) to Bell Aerospace
Textron which required the company to develop a
corrective measures program to remediate the are impacted by the contamination.
Subsequently, the company designed and installed both an off-site and an on-site
groundwater extraction system. Performance monitoring data indicate that those remedial
systems are achieving their design objectives. The source of the contamination (former
neutralization pond) has been removed, and the extent of the contaminant plume has
diminished. In September 1998, the Post-Closure Permit was renewed. DEC has
determined that the ongoing remedial activities are protective of human health and the
environment, and are achieving the remedial criteria specified in the Post-Closure Permit.
As continued operation of the remedial systems is necessary, Permit No. 9-2940-00001/00079 which expired
in September 2003 is being renewed. A fact sheet providing
additional information on the facility and its operation, and a copy of the Draft Part 373
