Stiefel Laboratories Inc,.
has applied to the Department for a modification to their
existing Air State Facility Permit. This permit modification application includes proposed
conditions for restructuring the permit to allow for permitting of the existing facility that
manufactures and packages dermatological products and performs research and
development activities. Operations to be conducted under the state facility permit will be
similar to those currently performed at the facility, with similar production levels planned
for at this time. An additional 10,044,000 btu per hour boiler will be constructed under
this permit. The facility will continue to be a synthetic minor facility, capping emissions
of oxides of nitrogen (NOx) and sulfur dioxide (SO2) @ 80 tons/yr each, volatile organic
compounds emissions (VOC) @ 40.0 tons/yr and hazardous air pollutants @ 20
(total)/8(individual) tons/yr.
The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application.
Project Location: The existing facility is located in the Town of Durham, 6290 Rt 145,
Green County, New York 12460.

(NYSDEC) hereby notices a complete application and proposed Air State Facility permit

disturb over 100 feet of a protected tributary to the Poesten Kill, as part of a wetland mitigation
project. The disturbance of the protected stream includes bank stabilization utilizing stone and
vegetation. Grade control
structures will also be utilized to stabilize the stream. The overall project includes 5.4 acres of
compensatory wetland
mitigation at Capital District Farms. The mitigation is being required by the Corps of Engineers
for the filling of federal
wetlands associated with the construction of electrical and gas transmission lines for Besicorp Power
project in the City of
Rensselaer. The wetland mitigation project is located off SR 351, just north of the intersection
with Dzembo Road.

The applicant proposes to
construct 161 single-family homes and 100 condominium
units, on approximately 123 acres of the 314 acre project site, to be known as Helderberg
Meadows PRD. The project requires a freshwater wetland, water quality certification and
an Article 15 protection of waters permit from the Department due to impacts to wetlands
and stream corridors existing on the site. The site contains approximately 121.57 acres of
Federal and State freshwater wetlands of which a total of approximately 2.42 acres of
Federal jurisdictional wetland area (containing approximately 1.4 acres of State
jurisdictional wetlands), 20.3 acres of state wetland buffer area, and approximately 345
linear feet of stream channel will be permanently filled/impacted for road and lot
development. To mitigate for wetland impacts, the developer proposes to create up to 3.4
acres of new wetlands on the project site, resulting in no net loss of wetland habitat as a
result of the project. As a form of secondary mitigation, approximately198 acres of the
property (including the created and remaining wetlands) would remain protected, via a
deed restriction placed on these lands to run with the land in perpetuity, as undisturbed
open space area. A home owners association to be established will be responsible for the
maintenance and protection of these lands. The project also requires the development of
a Stormwater Pollution Prevention Plan (for pre and post construction sediment, erosion
and stormwater control) and coverage under the Department's SPDES general permit for
stormwater discharges from construction activities. The subdivision will result in an
increased taking of water over the current water supply permit limit into water district No.
5 which will require the Town to obtain a water supply permit from this office. The
project site is located along the north side of County Line Road, the west side of the New
York State Thruway, the east side of the Conrail Line, and is bisected by NYS Route 158
(Guilderland Ave.) in the Town of Rotterdam, Schenectady County.
