Department staff
have determined that the application and the draft Environmental Impact
Statement (dEIS) prepared by the applicant is complete and adequate for public review. Staff
have also determined that a Legislative Hearing will be held to receive comments on this
application and dEIS. Refer to the SEQR and Other Notices section of this issue of the ENB for
more information regarding the Hearing.
The action involves
the modification of the applicant’s existing permit for a 125.5 acre dolostone
quarry on a 377.4 acre parcel. The modification consists of a request to expand the current 125.5
acre Life-of-Mine to approximately 259.2 acres. The mine will continue to operate as a
traditional surface excavation of dolostone by drilling, blasting, and processing with mechanical
equipment standard for quarry operations. Mining will occur below the water table and includes
dewatering. The excavated material is crushed, screened and washed and prepared for sale as
aggregate and other similar materials. This facility also contains three asphalt plants that
produce bituminous products utilizing material derived from mining operations on site. No
significant operational modifications are proposed for this mining activity as a part of this
application. Final reclamation will restore the site to a 201 (+/-) acre open water recreational
pond ranging in depth from 40 to 60 feet. At the expected surface water elevation of the lake,
a
sloped bench will provide a shoal area around the perimeter of the lake. Upland reclamation will
include replacement of stockpiled topsoil and reseeding with an approved USDA SCS seed
mixture to stabilize banks.
The mining site is
located south of NYS Route 5 and is generally bounded on the east by
Clipnock Road; the south by the former New York Central Railroad, Batavia-Canandaigua
branch; and by Fargo Road on the west. The mine is located in the Town of Stafford, Genesee
County.

The Department has received
an application from the Village of Spencerport for the
development of a regional duplex sewage pump station and 5.5 miles of 20 inch diameter
force main capable of pumping 3,600 gallons per minute, which will serve the Village of
Spencerport and a portion of the Town of Ogden. The regional pump station will be
constructed at the existing Village of Spencerport Wastewater Treatment Plant site on
Village property. The proposed 20 inch forcemain will be installed 1800 feet south to an
existing Monroe County Right of Way. The forcemain will cross the Erie Canal and
follow the alignment of the right of way to Long Pond Road in the Town of Gates where
it will discharge to an existing Monroe County Pure Waters interceptor sewer. As part of
this project, improvements to a portion of the Village collection system are also planned.
These improvements will include the completion of an additional gravity sewer crossing
under the canal. This project also involves temporary impacts to federally regulated
wetlands along the right of way for which a NYS 401 Water Quality Certification will be
required.
The Department has made
a tentative decision to approve this application. As a tentative
determination, the Department is seeking public comments prior to making a final
decision on permit issuance.

The Town of Manchester proposes
to extend the water supply and distribution system of
the Central Water District into its 3rd Extension and to take for use therein a supply of
water estimated to average 21,000 gallons per day and up to 36,800 gallons per day from
Canandaigua Lake sources (City of Canandaigua and Village of Newark). The project
includes 52,240 linear feet of water main and appurtenances to serve 131 new
connections along NYS Rt. 96, Co. Rd. 25, Field St., Bunker Hill, Bedette, Brown,

The Department received
an Air State Facility permit application from Kraft Foods North
America, Inc. for manufacture of various cheeses (Italian, Mozzarella, Ricotta) and
produces whey powder through a drying process. The facility does also mixing,
pasteurization, and homogenization. Kraft treats process wastes in an on-site waste water
treatment facility (WWTF). The facility proposes to add six new anaerobic reactors and
an 8-inch waste gas flare. The biogas generated by the reactors will be treated by one of 5
boilers or flared. The boilers can also burn biogas/natural gas mix, natural gas (NG), and
No. 6 fuel oil. The facility also operates exempt sources including NG fired whey dryers
and WWTF boilers.
As part of this application,
the applicant has proposed to restrict facility potentials to cap
emissions of sulfur dioxide and carbon monoxide to below the applicability thresholds in
6 NYCRR Part 201-6 (Title V) by limiting No. 6 Fuel oil use to 675,000 gallons per any
consecutive 12 months and by limiting the fuels sulfur content to 1.5% by weight. To
verify compliance, a cap tracking system will be implemented where records of fuel use
consumed will be tracked, calculated, and recorded. This facility was previously able to
cap by rule pursuant to 6 NYCRR Part 201-7.3, due to emissions less than 50 percent of
Part 201-6 (Title V) thresholds.

Instant Heat Wood Pellets Co Inc has submitted
an Air State Facility application for its
Tuscarora Plant, a new wood pellet production facility to be located on NYS Route 417,
approximately 900 feet south of the Addison Town Line. The facility will use saw dust
and wood chips from the adjacent Two Rivers Timber Company sawmill to produce
wood pellet fuel.
As part of this application, Instant Heat
Wood Pellets Co Inc has proposed to restrict
potential facility emissions to below the 6 NYCRR Part 201-6 (Title V) applicability
thresholds for a Major Stationary Source, by limiting wood dryer operation.
In response, the Department has generated
a Draft Permit restricting wood dryer
operation to 7640 hours in any 12 consecutive month period. Based on this and other
facility operations proposed, this will limit facility emissions to less than the Part 201-6
thresholds of 100 tons per year of particulate matter (PM), 50 tons per year of volatile
organic compounds (VOC), 25 tons per year of all hazardous air pollutants (HAP)
combined, and of 10 tons per year of any individual HAP substance.
To verify that the facility is in compliance,
Instant Heat Wood Pellets Co Inc will be
required to maintain records of operations and emissions at the facility. These records
are to be maintained for a minimum of five years, and must be made available with all
supporting data to Department inspectors upon request.
